I just received a NIP in the post for 81MPH on the M40.

I thought that there was some latitude for speeding I.e. Less than 82MPH on a motorway and you're fine? I take it this is incorrect?

Also what's the deal with the new fines? Do you get offered a speed awareness course and I take it that the days of 3 points and £60 fine are over?

Any advice gladly welcome - the fine is epic.

Cheers

Rule is anything over 70 is speeding. Most forces only prosecute 79 and above though (10% +2)

It is now 3 pts and £100 or a course if you are eligible.

Indeed, but it's purely at the forces discretion. I'm told Bedfordshire are currently running a zero tolerance policy, and will prosecute you for doing 71 in a 70.

Gets comfy, grabs popcorn and eagerly awaits a NIP to be posted here alleging 71mph in a 70mph limit.

Not sure - need to check. Didn't notice a flash, so assume it was one of the new digital ones. I haven't actually seen the letter yet, came in the post this morning. The Mrs told me I'd got it.

What he says is accurate though.

If the posted limit is 70, why would you assume that you can do 81?

Sorting of got a point though?

You know the limit is 70 (or certainly should do). If you're officially good to go at 82, that'd be the speed limit wouldn't it?
Facetious I know.

I didn't - I assumed that there was some latitude. Otherwise you spend your entire driving life looking solely at the speedo and not where you are going.

I thought the latitude was 82MPH, from one of the posts above - it's 79MPH.

Not really. Just get up to about 66 and potter along. That way if you drift up a couple of mph, you're still legal. Or given the speedo always reads a bit under, probably ok to get up to 70 and drift up to 72 on the clock.

If you genuinely can't concentrate enough to drive at or under the speed limit then you should hand your licence in. It's not rocket science.

Silly boy.....

try that when you are working, 6-8 hours a day in a hot car...etc etc....you WILL drift at some time.

There used to be ACPO (Association of Chief Police Officers) guidelines, but ACPO no longer exists, it is now NPCC (National Police Chiefs Council). They recommend guidelines, but emphasise any speed over the posted limit is an offence, and it is the force's or the officer's judgement. For 70mph the guidelines say 79mph is the lower threshold for a Fixed Penalty Notice. As for a speed awareness course(SAC), it will say that on the NIP if you are being offered one. As others have said, if you have done a SAC within the last three years (or, as I believe, if one has points already), you will not be offered a SAC.

Sorry - please can we get back on topic?

I don't want lessons on driving or views on my ability to concentrate or even "you've been a very naughty boy" type comments. If it makes you happy, please take all of the above as read. I.e. I'm naughty, st at driving and can't concentrate - everybody ok now? Good.

So will I get points and £100 fine, points and means-tested fine or offer of speed awareness course?
