Dealer Lied about FSH
Discussion
I bought a Merc three months ago for £7k. It looked tidy and was advertised as having FSH. After three months of talking to the dealer, I am now the proud owner of a duplicate service book with an incomplete record for servicing and some dodgy mileage that doesn't add up with the MOT records.
The dealer has admitted his error and has offered me a few hundred compo - what would you knowledgeable chaps say would be a reasonable amount to compensate for the reduced value of the car, now it turns out it does not have FSH.
Would it be better to give them the car back ?
Many thanks for your help

The duplicate book he produced after three months had four stamps in it but the mileage on the services did not match the MOT records. It jumped back 1000 miles over a week between the service and the MOT one year and jumped forward 2000 miles in one week the next. I can't trust the service history and it certainly is not complete.
The car seems to be in good shape but the wife wants to hand it back. The dealer says he will charge me 45 p a mile, which I'm pretty sure he can't do. I could be tempted to keep it but I have no idea how much the car is worth without a FSH as advertised. Would anyone have an idea ?

Have you tried Mercedes to see if they have any record of its history ? It could also be that the service mileage is correct and the mot is wrong.
45p a mile doesn't seem to unfair, it's a recognised number from hmrc. Given you have had some use of the car perhaps 25p per mile would be acceptable.
As for service history, jump on we buy any car stick the details in with fsh then try again with no service history and see what the difference is.

I have done about 2500 miles since I bought it. It has taken three months for the garage to get the service book to me which arrived this week - complete with dodgy mileage. The MOT mileage I found on the DOT website.
The WBAC.com idea is good Steve - I'll try that tonight with a dodgy email address or I'll be spammed for the next five years !

It was advertised with FSH but I noticed when I got the car home that the book with the stamps was not in the car. I called the dealer who said he would pass it on. It took three months of swapping emails, phone calls to receive a duplicate book with partial history and dodgy mileage.
Don't take this as me knocking you but if it was me in this situation I would apportion a bit of the blame to myself for not checking the history. I would not be seeking to hand the car back based on what is partly a mistake on my part. Have a deal with the dealer on some money back absolutely but this could have been avoided.
I assume being a Merc at £7k it is not a main dealer who sold the car?

I think you've been extremely naive in accepting the dealer's story without checking it, but the dealer is clearly dishonest. What are you going to do when you try to sell it? You'll face the same questions yourself from a potential buyer, if you conceal the clocking you'll be complicit in selling a clocked car. Ask him whether he's prepared to take it back now or after you've spoken to trading standards.
Before everyone starts saying the car is clocked and the dealer has miss sold don't forget he could have got the information from the last owner, most of the time it's the people px'ing the car that are unscrupulous they tend to want their cake and eat it.
If the book has been stamped up call the garage that has serviced it and double check the mileage, it's not unknown for the mot mileage to be entered incorrect.
If you really like the car and it's old enough I would be inclined to keep it.

What's the score with the mileage? If it might be clocked hand it back
If not, then I'd try get enough back to give it the service of its life and crack on - if your gonna keep it a few years it's gonna be worth peanuts anyway
The best answer was the first answer. If not, then I'd try get enough back to give it the service of its life and crack on - if your gonna keep it a few years it's gonna be worth peanuts anyway
I would imagine £500 will buy you a pretty monster service - see if that's the number you can extract from the dealer.
It'll be worth half a bag of sand to the dealer to get rid of you!
