was caught speeding back in 31/05/2017 by mobile camera van it has now been 5 month and have not heard back from the court for my summons I've filled in the NIP etc etc confirmed I was driving the vechle..... last letter I recived was please now await your court summons date but I'm still waiting am I right in thinking that if it goes past the 6 month period they then can't prosecute me??? please help

Give it another couple of weeks or so and you will receive your summons, probably about 2 days before the 6 months is up. Out of interest how far over the limit were you?

51 in a 30 was in an industrial estate but also can I say there isn't no speed signs indicating what the speed limit is along the road I generally thought it was a 50 but turned out it was a 30 frown

I think if there's street lighting then it's classed as a 30 if there are no signs.

I think you need to sit tight and keep your fingers crossed but expect to receive the summons within the next 4 weeks.

Are you a less than 2 year licence holder?

Yeah, i believe the Highway Codes states something along the lines of; if not sign-posted and there is standard street lighting, you would assume that the speed limit is 30 mph.

no been driving 7 year no points or convictions at all not even a parking ticket.... and it was an industrial estate only had lampposts on one side of the road had a camera sign but no speed signs or nation speed limit signs etc.... I always thought the speed signs should be below the camera sign

and so if it gets passed the 6month period and still not heard anything they can't prosecute me??

Ask the magistrate if you could be sent on a Speed Awareness Course.

Why would assume 50 rather than 60 if you saw no speed limit signs and it wasn't a dual carriageway?

I once got a TS10? Think it was for going through a temp red light which I had sat at for over 5mins, and it had been known to have been stuck on red previously in the week.

Feeling more than a little hard done by I ignored the letter and then heard absolutely fuk all.

I was later told by a cop that apparently the procurator fiscal only has the means to chase around 50% of traffic violations and so drop any that are not severe or that could be overulled by a judge.

You cannot say 'there isn't no speed signs' smile

Because of industrial traffic, these estates often have wide roads. However, I would never really expect industrial estates to be 50mph. Many can be lower than 30mph on their side roads.

On quiet days, industrial estates are often frequented by learner drivers.

what should I say?? I'm new to all this never been to a court before..... just plead guilty and ask for there forgiveness stating it was completely out of my character??

Just say you know you were wrong, dont come up with excuses. I did this when caught at 90mph in 60, ended up going to court as Scotland sucks for speeding.

Also told the judge I wanted to be a HGV driver (18 at the time so within 2 years of passing) and that a ban would stop me doing that. He gave me a sp30 with 6 points instead, meant I had to resit but no ban on my record which has meant I have had friendly insurance premiums since, most recent renewal is £470 on my e46 330i at 23. Points are gone finally but its still on my record for a while longer.
