We are gonna need dashcams for the road and pointed at the driver soon.


If you took a Mars bar out of your pocket (not eating it) and scratched your ear this could look like a phone, would be interesting if people started dashcaming themselves and produced the evidence in court.

I regularly talk on my Mars phone.

Dead easy defence. Call logs from provider prove not on phone. Bigger things to worry about in life

I prefer a Toblerone to scratch my ear whilst driving, the triangle shape is much better.

You don't have to be phoning to be using the phone. Changing tracks on an mp3 or whatever also counts. This means that the "check the call logs" is meaningless.

Not true. The offence isn’t one of ‘making a call which is logged by the service provider’.

This is from cps.gov regarding prosecution for mobile phone usage:

cps said:
The particular use to which the mobile phone must be put is not defined as an element of the offence. The prosecution must merely prove that the phone or the other device was hand held by the person at some point during its use at a time when the person was driving a vehicle on a road.

It therefore follows that the phone / device does not need to be seized before a prosecution can be brought.
As with any offence like this, ‘proof’ would be your word against BiB which means that if you want to dispute that you were holding a phone you’d have to take your chances in court.

I didn't mean scratching your ear with the Mars bar silly I assume one would use a finger whilst holding the Mars bar, it was just an example, could be any snack/calculator/memo device/mp3 player anything that looks like a phone.

Never use my phone whilst driving, I just thought it was something to think about seeing as there are so many people moaning about not having a phone in the car at all and the police are not interested in checking this.

Dash cams pointed on the driver could come in handy. Stay safe out there.

Toblerone are okay but aren't they left hand drive. I'll stick with Dairy Milk, designed for UK use. smile

I strongly suspect that a sizable swathe of people who loudly proclaim their innocence are fibbing.

Why on earth would anybody be scratching their ear for an extended period with a Mars bar in their hand?

Nope I don't use the phone or confectionary whilst driving I was weirdly thinking outside the box (of chocs) that if the police said you had a phone it would be interesting in court if your dash cam shows a Mars bar.

This thread has cheered my up no end on a boring Monday morning.

There are quite simple and straightforward defences to accusations of using a hand held mobile phone. A quick search on the internet provides quite a menu. One must suit. Another way of obviating the charge is to have your mobile in a carrier.
