Speeding ticket.... I was in bed, car on drive
Discussion
So i got a speeding ticket through today.
Apparently i was doing 66mph in a 50 zone next to Luton Airport last Friday at 10.30pm
Well unless i can sleep drive, this was not me!
Registration is correct but the car was parked up on the drive and me and Mrs. Haddock can recall having fish & chips for tea then an early night. We are 55 mile, 1 hour(ish) away
I'm pretty sure it's cloned plates as the car was all over Facebook, eBay & gumtree as I was selling it (sold on the sunday)
Anyone had a similar problem? Can I call up mr Plod on Monday and plead my case?
Annoying...!!

Not necessarily a clone. Misreading of a VRM by someone in the processing unit is just as likely if not more so.
Of course you can challenge it but I wouldn't do it by phone. Everything in writing when dealing with officialdom..
Mrs H can attest to your actual whereabouts* if they won't drop it and it goes to court.
* No sordid details though.

If you can prove where you were send a letter back to them quickly asking them to check the registration.
I had an NIP through for one of my motorbikes the other year but could prove I was at work and the bike was notified off road tucked away for the winter months.
Got a letter back within two days saying it was a misread on the registration plate and it was actually a car not a motorbike.
Mistakes are sometimes made.

Make a note on the form to say you were the keeper at the time but the car was on your drive at the stated time (state what times it was on the drive from and to so that any discrepancies with the hour going back recently can be dealt with in the one statement. If there is no room on the form, attach a seperate letter to the form and refer to it.
Make a copy and send in 'signed for' by visiting your local post office. This is your proof of posting if you were to need it.
You could get further advice from pepipoo, loads of similar threads.

We received a NIP once but the SC was 24 hrs out.
As you say "Mistakes are sometimes made" but try and prove it sometimes.
You don't have to prove anything. If you dispute an allegation, the burden of proof is on the party making the allegation. This is not just blah- it's a real and effective principle. This is not to say that it is not a good idea to put forward whatever material you have to rebut a contention that you disagree with, but that does not alter the onus of proof.

You might not have to prove your innocence but you do have to nominate a driver or get shafted anyway. No space on the form to tick the box that states "please tick here if we haven't bothered to check anything in our insane grab for your money"You don't have to name the driver if you really don't know who was driving. You seem to see the world in very simplified terms, but do you suppose that, for example, a speeding charge based on someone driving at 100 mph in a 30 mph zone would be an insane grab for money?
In the present case, the OP doesn't have to say who was driving because his car was not the one doing the speeding.

No option on the S172 to say that though You then have to jump through hoops sending photos in etc. proving your innocence. If you just say fIn the present case, the OP doesn't have to say who was driving because his car was not the one doing the speeding.
k off I was in bed then it wont end well at all.A letter saying "I believe that there has been an error in transcription of the number plate, or that if correctly transcribed the vehicle that was speeding was using a false numberplate. At the time of the alleged offence my vehicle (colour, type and number) was parked at my address. I had its keys and was at home at that address." would in most such cases do the trick. A minor hassle, but not a mega problem.
Not a NIP but last month we had a congestion charge fine for one of our vehicles, the said car was park in Gatwick airport Long stay car park and the keys were in greece ( i had the spare at work admitted) a quick call and the operator checked the images, asked what vehicle it was and minutes later its cancelled being the wrong vehicle and a misread of the plate.
