You missed some words out of your thread title.

A woman motorist from Horncastle who caused a fatal crash while chatting on her hands free phone was today (Thursday, November 30) warned she faces a jail sentence.

Samantha Ayres,(34), of West Street, was on the wrong side of the road when she collided head-on with motorcyclist David Kirk,(26), on Baumber Road, Horsington.

3 years. Out in 18 months?

I'm sure it was an important call.

OP, can I suggest you rename this thread to

"Stupid bh does a manslaughter on an arrow-straight, completely flat road because she's 100% focused on borrowing £40 off her mum and chatting to some bloke about VW camper vans and then turned on the tears when she realised she's going to pay for her actions... And we share the roads with people like this!?!?!".

This should help avoid duplicates as your current title bears very little resemblance to the story you link to.

"Woman faces jail for using handsfree phone"

That's not true at all laugh
It's for causing the accident that happened, which may in turn have been caused by using a handsfree phone (or that may have been a contributing factor)

My title was accurate.

The judge of the case deemed hands-free devices ‘dangerous.’

Judge John Pini QC said: “The fact that using a phone (hands-free) is lawful does not alter the fact it is a distraction. Guidelines make that clear.

“The jury are of the opinion using a hands-free in these circumstances is dangerous. There has to be a custodial sentence.”

At least she faced jail, the case is very similar to this one where the offender got away with it as she claimed the phone was on her lap

She pleaded guilty to causing death by careless driving, but a jury found her guilty of causing death by dangerous driving.

Sentencing starting point for a level 3 offence ("significant risk") - 3yrs custody.

The CPS didn't think there was sufficient evidence to bring a charge, even of death by careless driving.

Big difference - one was on the wrong side of a straight road, and hit another road user head-on. The other simply pulled out of a junction without looking.

(And she wasn't a "policewoman" - she was a special.)

There's no such thing as the 'wrong' side of the road.

You'd be quite happy for anybody to drive on whichever side of this road they fancied, would you? Regardless of if you were heading in the other direction on a motorbike?

Road Traffic Laws allow people to drive on the opposite carriageway, when and where appropriate.

I'm not condoning the actions of the idiot woman, however calling it the 'wrong' side of the road is erroneous.

Are you suggesting that "appropriateness" test applies in this instance?

Because, if not, "wrong" appears a fairly convenient and accurate verbal shorthand.

I'm not commenting on this instance at all, I'm merely stating the the use of the term 'wrong' is incorrect when applied to driving on the opposite carriageway.

This is a motoring forum, supposedly visited by enthusiasts...we can do better than "wrong side of road", it's like saying "slow lane / fast lane".
