Long story short, my wife has just come out of a HR meeting to be told that her employment is being terminated.

They have said that another (full time) employee has said that she wants my wife's job, and as the FT employee is on less wages and not on probation they are getting rid of my wife to make room for the other employee. My wife is still in her probationary period.

They have said that they will be basing this on the reasoning my wife has not met the "probation requirements" however they also said that it is for cost cutting reasons as well.

My wife has never been informed that she was not meeting the requirements, and her probation was extended after the initial 6 months due to her boss (at the time) showing her the wrong way to do her job. He was sacked, and the new boss extended the probation to asses her after being shown the correct way.

I have yet to read the letter, this is the information that has been relayed back to me on the phone.

Obviously the Mrs is distraught, given the time of year, and feels this is HUGELY unfair... does she have any recourse, or is she best placed just to move on and look for somewhere new?

Less than two years, and they can pretty much do whatever they want so long as it doesn't breach the Equalities Act.

Best to crack on and start looking asap. It's very unfair but not really much you can do in first 2 years. Is she getting PILON?

Pretty standard operating procedure for some companies to make some st up to extend the probation period. It wasn't a local authority was it?

Be supportive and help her move on, places that pull this sort of game often end up being stressfull and unpleasant to work in so better out now.

Not an LA, no, a large national company specializing in forklift trucks

Get proper advice. Don't just listen to what a load of car fanbois think.

References are important though - if she can get them to agree to a good reference, that may make re-employment elsewhere smoother.

A lot of these car “fanbois” are solicitors, especially in this section.

As has been said, less than 2 years, they can do this. Local large company near here do it all the time, they keep a nucleus of people then hire on "probationers" getting rid of them after 22 - 23 months, then offer them new contracts some 12 weeks later.

The best think that she can do is not to fall out with the company, but actually to grovel a bit, say that she understands that the other woman has more experience etc. but would like be be given the opportunity to return should a vacancy occur, then ask them for a reference to assist in her search for another job.

Yes, I know that she'd probably like to bomb the place down, but that gets you nowhere, and in this day & age you can't burn bridges.

Check for an ism and a NWNF lawyer.

Racism, sexism, ageism, verbal abuse, inappropriate comments, sex pestery, etc. etc.
