Car Rejected - What Next?

Hi all, hope your well and enjoying what is left for the weekend.

My car got rejected in July 2017 by the ombudsman and I am still waiting for BMW to collect the car, all is well however I have a question: I have been told by someone I will get all my deposit back, regardless of the wear and tear I have caused?

Is this true, the car has some scuffs on the body work and it has not had a major service since I bought it.

Does anyone have any advice or experience?

They haven't collected a rejected car for 6 months ?.....okeedokee.

Nope, my insurance is expiring in March so I want it gone before that.

How is it 'all is well'?
A car was rejected 7 months ago yet you still are in possession of the car?

That is quite literally the opposite of going well.

All is well, as I have been struck with a disability so the use of my car is very much needed.

To put it bluntly.

The car clearly hasn't been accepted as rejected.
You shouldn't be driving around in a car that you have rejected otherwise it is clearly fit for purpose.
You won't get your full deposit back. Wear and tear will be taken into consideration.

Sorry about your disability but we need more details if we are going to help.

What car is it?
Why was it rejected?
Why do you still have it 7 months after rejecting it?
Has anyone formally accepted that the car has been rejected?

Surely that makes your ‘all is well’ comment make even less sense then.

Start again and give us a few more details and a proper timeline about what’s gone on. You’ll get more helpful replies then. And sorry about your health issues.

'The Ombudsman's does not reject cars - although they can uphold a person's request to reject a car. More details really are needed.

But as soon as you notify a dealer of your intention to reject a car, you shouldn't be driving it. Otherwise it's very difficult to argue the grounds for rejection.

My sons car was ordered to be taken back by the FO*, and yes it was BMW as well.

The dealer was roundly useless from the start, which is why we ended up complaining to BMW finance (where the dealer never responded to them at all) and then the FO.

Needless to say they were pretty hopeless at collecting the car as well, not helped as after the FO ruling (which isn't actually a rejection at all) BMW finance didn't send the notification to the dealer until we chased them first. It took about 6 weeks in my sons case.

So first steps first, who have you chased in the last 8 months? You start with the finance company and then the dealer.

Some of the advice above doesn't seem to understand the process.

  • strictly they nullify the finance agreement and as such they have to take the car back as part of that process, it will stipulate how much they must return in terms of the deposit, any payments and any interest.

Is the car on finance? Have you been making payments?
