Company gone into administration - advice needed
Discussion
Hoping to just get a quick bit of advice on this!
Partner works for a retailer that has just gone into administration. She's on a zero-hour contract as a floating manager and so has her expenses paid for everywhere she visits.
She is currently owed wages and expenses that are apparently going to be paid (fingers crossed!), however the question concerns future wages and expenses from now, plus accrued holiday. She's been told that as she's zero-hour that now they're in administration that they don't have to pay her accrued holiday - is this correct?
Also she's of course down to work this week and next etc, meaning she's going to accrue a lot of expenses and wages that we aren't sure will be paid. She only has to give 1 week's notice which she is happy to do, however are you in a better position to get your money if still employed or does it make no difference?
She doesn't want to work anymore if she isn't going to get paid or her expenses if that makes sense?
In terms of a buyout, it looks like all the stores will be shut as the only potential buyer doesn't want them.
Thanks!

She's on a zero hour contract. Chase for the payments due but save your money and find work elsewhere.
She's got another (properly contracted this time!) job thankfully, starts Monday! Just really wants to know if its harder to chase for money when you aren't employed there or if it makes no difference?

She done the right thing by trying to secure her future and looking forward. It makes no difference whether you are still employed or not. If you have worked the hours then the pay is due. Keep a record of the names, numbers and email addresses of any finance people and any senior managers. Get some contact details for the administrator. Send an email or a recorded letter detailing the amounts outstanding. That's as much as you can do in the circumstances for now.
Great thanks, that's helpful!thecremeegg said:

Not up to speed with zero hour contracts but how can they stipulate a weeks notice on such a contract.Partner works for a retailer that has just gone into administration. She's on a zero-hour contract as a floating manager and so has her expenses paid for everywhere she visits.

You could give the weeks notice and they may not even give you any hours, which doesn’t seem right.

Give the weeks notice, take all your holiday for that week. As it occurs during administration, the administrators will have to pay it.You could give the weeks notice and they may not even give you any hours, which doesn’t seem right.
