My 3 points (SP60) are now three years old. But my insurance company 'take them into consideration (up the price) for 4 years' I thought points expired after 3 years, or is it actually 4 years before I can claim to have a clean license?

Points are only valid for 3 years.They stay on your Licence for 4 years for 'admin' purposes.

I work on the basis of getting them cleared after 4 years and forget about them.

Only need to declare information to the best of your knowledge when appying for insurance. Without any official record of past points, and if I had any I lost it; I consider that I have suitably met this criteria when applying for insurance.

This is how I work and feel comfortable with it, I do not encourage anyone to take path.

Does anyone know if the "Rehabilitation of Offenders Act" applies to motoring offences (which are criminal offences)?
If so, then surely, in the eyes of the Law, after three years you can legally claim to have no criminal convictions.

Thanks for the replies, so it appears that an insurance company can hold points against you for 5 years, even though technically, they're gone after 3 !! Great................

I had this conversation with my broker the other day,
The reason they last for four years is "the insurace company is looking at your driving history"
Ok I can see it, just.
Nothing to do with continuing to load your premiun for as long as poss, as 5% is tax this is probably more like it.
For anyone who has had points added in pen buy the mags, it is hard to believe but ask DVLA for a new licence £19.00 it may come back without the hand added points.(it can and does happen)

My renewal is due tomorrow, and when I phoned to confirm, I actually asked this question (I got 3 points just over 3 years ago). The response was, "as an insurance company, we are allowed to so that we can properly assess the risk"!!

My three points expire in July...I'm *amazed* that during the time I haven't accumulated any more!

I won't bother getting the licence cleaned up for another couple of years though...since I'll need to tell the insurance company about it!

Points on the license are valid for 3 years in terms of totting up.

Points stay printed on your license for 4 years.

The conviction leading to the points may only be regarded as 'expired' under the Rehab of offenders act after 5 years.

Insurance companies ask you about convictions, and you are required to answer 'in good faith', so if they ask for 5 years, your are required to disclose anything within 5 years, or potentially your insurance is invalid.

If an insurance company asks beyond 5 years, you are entitled not to disclose anything over 5 years due to the ROOA.

Al clear as mud?

And the reason they stay on your licence for 4 years:

If you get 12 points within 3 years you will usually be banned for totting up. If points could be taken off your licence immediately expired, then in many cases you'd be able to get the early ones taken off before your last case actually came to court, thus evading a ban.

So they stay on for four years to allow 12 months cases to come to court.

The next question is: if they are removed from your licence after 4 years, does any record of them then exist anywhere?

Really? I'm moving house in a couple of weeks and have an older paper licence with a hand written endorsement. Trouble is you're supposed to send the old one in for a free replacement as it's change of address.

A foreman at work seems to think brake fluid does a good job at removing pen from a licence, and reports to have done it himself (and he is a Scouser, so should know every dodgy scam under the sun!!)

Someone I know has 3 DD convictions approx 15 years, 12 and 10 years ago. The last conviction was for 10 years which has just recently expired. As he is now sober he applied and got his driving licence back.

When he got his licence back the insurers were not interested in the convictions at all. Since the date of conviction was in 1994, despite the ban lasting until 2004 the only "penalty" was 0 no claims discount.

Presumably the record is kept on the insurance co's database?

If you apply for a new license due to change of address, it'll come back in whatever state it "should" be. Therefore, if the points are over 4 years old, they'll magically disappear. If you just want a clean license, you can apply for one after the 4 years are up and pay the fee to get one.
