Guy pulls into bus stop on empty road on christmas day, no buses running collects £70 fine

The Council says it's going to pursue it through the courts
If it goes to the Traffic penalty tribunal, the first thing they seem to ask is has the council used its discretion
Apparently there's some law that a council must use its discretion when appropriate
Is this one of those times?

Yeah, looks like absolute gridlock there doesn't it (in the picture)

The council needs to explain why buses stopping in the same place doesn't cause danger to cyclists and other traffic, but stopping a car there does, even when there's almost no traffic.

It's a breach of the highway he's committed and the council are absolutely right to prosecute him.

He should have parked somewhere sensible like everybody else.

The mayor said:
While we do recognise the good intentions in this instance, ample safe and legal parking was available within just a few metres of the bus clearway.

Everybody else ? you can see then all queued up to park hehe

Another way of looking at it is, would an officer or the Law have bothered issuing a ticket or used discretion

For those who are interested, it's here, outside of the train station:

As a local - it's not even close to being dangerous, and the council can do one. No-one in a car goes into that leftmost lane unless they're turning into the station just out of shot, you'd just get blocked by people turning left and cars parked further up, at which point it turns into a bus lane anyway.

The correct answer would 100% be "no buses running, drop it".

Leicester's City Mayor has said he will do everything he can to cancel a fine for a charity worker who stopped in a bus lane to help a rough sleeper on Christmas Day.

Lee Williamson was issued with a £70 fine after giving food and clothes to the man outside Leicester railway station.

Sir Peter Soulsby, speaking to BBC Radio Leicester this morning, said: "To punish him for doing a good deed on Christmas day is crazy, rules can be taken to an extreme - we should do everything we can to make sure Lee isn't punished and the fine is cancelled."

Looking at it from the other side.

How many people could stop in places and claim they are doing a good deed to get off ?

I tend to find our society does is not conducive to people doing good turns.

Like the Jewish private ambulance crew who stopped at accident to help and after that the police reported them for misuse of blue lights.

If they proceed would it not be interesting to hold the authorities to account for breaking the law dating back to James or Charles II by working on Christmas day .
Or has that been removed along with it being illegal to go to Church on boxing day unless on foot . There used to be some weird and wonderful laws sorrounding Christmas and boxing day including the consumption of mince pies and fruit cake .
