I know it sounds harsh but it's not the director who owes you money it's the nursery that you paid the money to. The liquidators are the people you need to contact if you are a creditor.

thanks but there are no liquidators or administrators that i can find nor a winding up petition, the director just decided to close both companies,.

one was limited but the one we were at was not, so I just need an address to send small claims paperwork to, (they can then defend if they want to as our emails are not being answered)

thanks

As I understand it, if it's a limited company, there will be a liquidator. I don't think you can just close it.

I may be wrong, but I'm in the process of closing mine, and have had to appoint an administrator.

Two listed as living in Cornwall only 1 is a director (might be the same person looking at the dates). You need to pay for full details. HTH. thumbup

I'm in the process of setting one up and won't be having my home address anywhere near it, to purposely avoid the chance of ever having anyone at my door.

There's some odd folk out there.

It may be wise and beneficial but I'm pretty certain there is no legal requirement unless the closure is enforced.

As long as there's nothing owing or owed, you simply calculate the final tax liabilities, pay that and then distribute what's in the bank account to shareholders and inform companies house.

I may be wrong too, though!

A company can be wound up without a formal liquidation. It is called "Striking Off" and is a very popular way for small companies to be wound up as it is very cheap and easy.

Before a company is struck off, The Gazette posts a notice stating that the company has applied to be struck off. Individuals or organisations that are owed money by the company have three months in which to block the striking off. Of course, in order to be aware that the company has applied to be struck off, a creditor would need to be checking The Gazette to review what companies are applying to be struck off. The vast bulk of people and businesses don't do this. In fact, the main creditors who block striking offs are banks and HMRC.

Once upon a time Companies House did indeed list the home addresses of directors. However, after a number of incidences where threats were made against directors and their families (often by activist groups such as animal rights organisations), the law was changed so that personal addresses were hidden. One director was actually sent a bomb in the post.

An incident is a single event or episode:

Incidence is the rate at which something happens,

Thanks for the correction. I hope you got the gist of what I meant though.

What are you going to do when you find her address, send the boys around? If you look at the company's financials it's insolvent whether it's been wound up or not at this time. It's clear from the news article that someone posted earlier that it's been closed by Ofsted and that both nurseries were owned by the same limited company, so as annoying as it is, the directors don't owe you any money - the insolvent company does.

You can be the one who issues a winding up petition as a creditor but that will only end up costing you more money for very little chance of a return.

I know that everyone blames "greedy/crooked business owners" if a business fails but often you'll find they have already put all their own money and assets on the line to keep a business afloat so very rarely end up on top if a business goes under. It certainly doesn't look like MS Ulen has a habit of setting up a business, running up debts and closing, as this seems to be the first time she has been a director and she's in her mid fifties.

As I said in my first post earlier, it may sound harsh but it's unlikely you're going to get anywhere unless you can PROVE the director was trading negligently.

Not sure what you mean here? Either it was a limited company, or, it was a sole trader/partnership setup. Unlikely to be an unlimited company.

Think what the OP is saying is, the Director of LTD company was also the sole trader of a business in which he used and is now owed money and is trying via the LTD company source, to find the home address to serve paperwork to try and reclaim the money.

But the OFSTED report says they are both owned by the same Ltd Co?

BTW, I'm not defending that company or its directors, just pointing out to the OP that he could be throwing good money after bad. The first course of action would be to determine the legal status of the nursery he paid.

Thanks All, I am not looking to send the boys round,

i started a moneyclaim online but did not realize the address listed was the other business. so it has come back

annoyingly we had just paid for the month and the next day she rang to close which meant we had to find childcare short term (we were looking to leave anyway) unfortunately the childcare vouchers could not be called back, its not a huge amount of money (£300.00 in total) but more the principal of the matter.

the nursery my son went to has closed but all the toys are still in there, I am not the only one owned money some of the staff have not been paid either from conversations with them,

you are correct one was ltd the one we used was not,

I will keep hunting and update when I have some news.

thanks for the clarification on home addresses as I thought I was going mad, thanks also Eric on the winding up as I think that is what will happen.
