Where do I stand with this PCN?
Discussion
Bare with me, this is a long one.
I got a new car on 25th October. A day later I purchased a monthly pass for the car using PayByPhone. A personalised registration was assigned to the car a week later on 1st November (I know its something which is frowned up on PH). I called the incompetent PayByPhone the same day to update the registration on my account and ongoing parking I have in place (Unable to do this on the app as there was an ongoing parking session)
Had no issues with parking until the 20th November where I received the first PCN. I appealed the ticket and supplied them with screenshots which showed the registration of my car and the time remaining and they cancelled the PCN. They advised me to correct the registration and so I called PayByPhone again to update the registration and the customer service advisor said it had already been done.
On the 28th November I received another ticket. However, this time when I appealed the ticket they rejected it on the basis of not having a 'Valid PayByPhone session in place'.
They gave me the option to appeal the ticket using POPLA which I did. My mistake here was not seeking advice at this stage where there are people out there who know how to successfully appeal through POPLA. I made the appeal and forgot to mention the second phone call that was made to PayByPhone. Even with this piece of information missing, it wouldn't have been enough to get a successful outcome from POPLA and agian my appeal was rejected on the basis of not having a 'Valid PayByPhone session in place'.
My frustration lies in fact that in both of the appeals they have failed to understand that I did what I needed to do to update the registration and the PCN was a result of the incompetent customer service advisor at PayByPhone not updating the registration correctly so it was out my hands.
Some of you will be wondering why I am asking for advice now and this due to POPLA taking there time to assess the appeal.
So where do I go from here?
Thanks in advance

Write to them setting out the actual facts.
Finish by saying that if they are unable to understand and accept these facts, then you would like the matter placed before the County Court so that a 'grown up' can decide the facts and liabilities.
Then watch it all go away.
Will I still be able to do this even though the PCN is about to move over to the legal action stage and a text was sent that the letter Before Claim is pending?Finish by saying that if they are unable to understand and accept these facts, then you would like the matter placed before the County Court so that a 'grown up' can decide the facts and liabilities.

Even if you've had a letter before claim, you can still send them your version of events and advise them you'd be willing to see them in court if they don't want to cancel it.
Is there a template that I could use? I just don't want to make a mistake again like I did with POPLA.Gassing Station | Speed, Plod & the Law | Top of Page | What's New | My Stuff
