It's meant as a deterrent.
His actions had the potential to cause a huge accident if the fast moving freight train derailed if it hit him.

On the face of it maybe but considering he was driving whilst disqualified the sentance is more realistic.

Surely opening the gates isnt the issue, thats easy to do as theyre manualy operated
What you have to do is make sure there isnt a train coming before driving through.
There are no half barriers or wigwags so to convict dont they have to show him going through a red light
Is this a red light, lower right? or a reflection in a window?



Are you sure the conviction is not for going through the crossing but for driving while banned?

Tbh if you're driving whilst disqualified and you open the closed gates to go across a railway crossing you get what you deserve.

I'll go off the article and presumably the evidence the court saw which says he ignored warning lights.

Still a mystery
The warning signs may just say dont use the crossing when theres a train coming.
Its probably your first point that hes been caught on video driving while disqualified

I would suggest if the lights weren't working there would have been quite a fuss about it in the article, especially as there's been so many recent accidents here in East Anglia.
