My 8 year has had bad slip on a badly maintained section of pavement. The is compounded by the fact my local council leaves grass cuttings after grass cutting on the pavements which when it’s degrades has in the case be part of the slip hazard.

Not the nasty cuts and grazes, she has snapped about 40% of one of her two front adult teeth and now require cosmetic dentistry.

Really??

Kids fall over and injure themselves all the time, I can't understand why you should be taking legal advice, this isn't America.

When around 14, I was riding along the road trying to get in front of a slow moving bus, after my BMX was at its top speed and I was passed the bus I fell off and smashed my front tooth in half. Should I blame the bus for going too slow? It happens sadly, the nhs will pay for the repair to the teeth.

Last time I was in America I was very impressed by how they were jet-washing footpaths in the residential area we stayed in. The ones around us are a horrible crumbling mess.

Not good - hopefully a speedy recovery for the young chapette.

Give the kid a clip round the ear for being clumsy , and tell them to watch where they're walking . HTH

Any number of ambulance chasers touting for business.
Take lots of photos of the scene & the injury, get medical reports and give one of them a call.

The incident as happened as they leave te grass cuttings to rot on the pavement apart from the cracks she slipped on a section of decaying grass cuttings as the council just leave their cuttings on the pavement and do no grass collection when cutting.

This is cost saving measure but in this case it has left a dangerous trip hazard in the middle of the pavement. My daughter has smashed her front adult tooth and now is disfigured. I think they have failed in their duty of care.

The final result being that the people of this country are slowly being turned into a bunch of weak, pathetic individuals who won't take any responsibility for their own actions and every activity needs a "certificate" and a hi vis vest.

Ps. My friend's young son did similar to his tooth. Not once has anybody mentioned legal advice or blame...

thats what kids do - its how they learn - I hope you are not thinking of making a compo claim ? because that will cost alll council tax payers one way or the other and local authorities are already short of cash which is why less money is spent on pavements and why the grass cuttings are not collected. As a result we all need to be a little bit more careful and perhaps you should have given a verbal warning of potential dangers or played a 'game' to identify them to the child before you went on your walk.

Presumably this isn't the first time they've done this & you being aware of this hazardous situation have several recorded warnings/complaints to them about the obvious risks to you that they were running?

I'm with you, we are paying more and more for less and less services, the state of the pavements and roads here is piss poor, the standard of work is low and the work that is done is by the lowest bidder so there is zero pride and no comeback for the poor quality.

If the councils wish to pretend that they are a business rather than just getting down to providing the services we pay for then they can be treated like any negligent business and get pursued for compensation as and when something goes wrong.

If the path was on private land, in a factory or something then obtaining compensation from the evil boss or "corporation" would be seen as the norm, just because its a local council people think they ought to be immune from responsibility.

Good luck with claiming.

Perhaps, but isn't the alternative that the public bodies of this country are slowly being turned into a bunch of weak, pathetic organisations who don't get asked to take any responsibility for their own actions.

A kids tooth gets smashed because the pavement is in a state and everyone mocks the OP for asking about claiming. An poxy alloy wheel gets wrecked on a pothole and the PH massive is up in arms, demanding the council cough up.
