Austrian Speeding Fine

Hi,

After some advice regarding a speeding fine we received through the post, from a trip to Austria.

The letter is addressed to my wife, who's name the car is in, although she was not the driver. From reading the EU Cross Border Enforcement Directive, they appear to have not acted lawfully as the ticket should have been in the language that the vehicles registration certificate is in.

Is there a time limit for how long to receive the ticket as the offence was the end of March and we have only just received the ticket, with minimal time to resolve the issue before the 31st may.

Do we need to pay the fine and how do we go about correcting the ticket to the driver not the owner?

Unlike the UK, Europe do not care about the driver for those offenses as there are no points to be awarded so there is no concept of "correcting" anything as there is nothing to correct as the car is fined, and the owner should sort it out with the driver.

For 60 Euro, just pay it unless you want potential hassle when you next fly into the country.

That’s not what the directive says. They don’t have to provide a translation service where criminal proceedings have not commenced. However, you are supposed to be sent an ‘information letter’ in an official language of the member state where the vehicle is registered. Tell them you want it in Welsh.

You committed the offence so just pay it. Its only 60€ and you aren’t getting any points so no effect on your insurance. If you don’t pay it you’ll probably have fun and games if you ever try to go back into Austria.

I thought it was the case that they could fine and endorse UK drivers when over the border but is the only country that can't send fines abroad due to something different in the way we handle speed fines.

Can someone fill me in?

I do think this is a grey area - we are getting a a couple of these each week for our fleet, and we are sending back our standard reply with the operator details. Having spoken to a number of those operators, only 1 or two have had any follow up from the issuing authority, and we have not had any formal responses or rejections yet.

It seems that obtaining the keeper information across borders is one thing, but actually doing anything with it besides sending a letter is an entirely different matter.

Similarly with the M50 Toll in Dublin - we get hundreds of fines each month for it, and although hire companies in southern Ireland can transfer it to the hirer, the company here in the UK that chases the "debt" only wants the money.
After a long conversation with the operators in Dublin, I learned that once they transfer details to the UK debt collector, the unpaid toll is
wiped off their system. The UK debt collector have now admitted they can't instigate any enforcement or court action here in the UK, and as there is no debt showing in Dublin, the original authority will not start any proceedings....
I wonder if a similar system operates across Europe...?

No foreign country can endorse a UK driver.

They don't even endorse their own drivers so they would not even think about that.

More to the point.

Was the driver at the time speeding?

if the answer to that question is yes and the fine is only 60Euros what the hell are you doing wasting your time trying to find a way out of it?

Sometimes people need to look at practicalities and the cost of their time.
