12 months ago a van crossed right over in to the path of my pick up. Had dash cam footage prooved I was not at fault along with separate witness to confirm. Insurance confirmed this as my insurance renewal was not effected. Now today I receive court order papers from a solicitors stating I was going round a blind bend (the road was straight) and I was speeding (dash cam says otherwise) and I was being sued for £6000 - van, van hire, storage etc. I will pass to my Insurance company but How can this be Right?????

Because people think they are never wrong when driving. And most importantly the van driver has probably realised that there is a huge excess to be paid to get his van fixed.

i suspect some leech company has got hold of the details of the accident and got in touch with the other party and persuaded them to persue you on a no win no fee basis

The third party can bring a claim no matter how weak their case is as long as there is a solicitor out there who will take it on.

OP, do you still have the dash cam footage and witness details?

probably find the leech cowboy claim company are hoping that the insurance company will cough up because its cheaper to pay than to fight it in costs.

Send it to your insurers.

I do sometimes wonder what the reaction of the ambulance chasers would be if they were aware of & had sight of dashcam footage proving their client is a liar.
Assuming you still have it I'd be interested in the opinion of our learned friends re sending the ambulance chasers a copy.

At what point does it become fraud, and when will the police become interested?

I believe there is an offence of attempting to defraud an insurance company. If it’s as blatant or clear cut as you say it is they might be interested in reporting it and taking it through to conviction. You’d need to be at court to give evidence.

Whether you can report yourself and get taken seriously I don’t know. The more these scammers are shown up and punished for it the less it’ll happen.

See Rashomon effect.

Almost impossible to prosecute for fraud over a different version of an actual event. Lying about the number of passengers injured, or claiming you can't walk and then getting filmed doing Iron Man, then maybe.

Has the other guys insurance paid out for your excess and your insurer's outlay?
If so,a bit hard for him to blame you as they will have used his statement about the accident

Just make sure your Insurer happy to take this to court rather than settle. £6k not a huge claim and they may be tempted just to pay.
