The answer is "No" because this is not a tax case.
There have been many similar cases over the year.
Of course, if HMRC wants to contest the "Tax Status" of this individual, they are free to do so - but they know that just because an individual is deemed to be employed under an "Employment Status" case does not mean that they are deemed to be employees for tax purposes.
