My neighbour was side swiped in his near on new Discovery a few months ago,100% third partys fault one witness with numbers exchanged and Police attended,courtesy car provided etc and just got his car back all done and dusted,End of...
No.. Gets a phone call from his insurers asking for more information about the accident mainly how many occupants were in the 3rd party's car. ? One was his answer,well we will require you to make written to that affect,Why he asks..? Because the 3rd party is claiming he had THREE passengers in the car with him and ALL HAD SUFFERED WHIP LASH... Bang to rights IMO blatant fraud,hope they throw the book at ALL of them.. judge

The claim would need to be off the at fault insurance anyway not your neighbour's insurance, could be the same insurer of course or perhaps a request passed through?

I'd be contacting the police, if they attended I would expect they'll have a note of how many passengers there were.

I would hope they'll take a bit of interest in it...

Sorry,maybe i didn't make it clear when i said "his" insurers it's the 3 rd party insurers that want the information,so even if they did pay out (which i doubt) it's nothing to do with my neighbour's insurance as he was not to blame.

Makes sense.

Hopefully they will be prosecuted and all costs for the damage they did to your neighbours and their own car reclaimed from them, then place them on a register to ensure that if they ever get a company to insure them again they are paying a premium to help cover fraudulant claims and so any future claims are put under the microscope.

I would state your view of the number of passengers, and refer them to a police incident reference number for their comments.

Insurers are ste at this sort of thing. I had an imaginary witness appear a few months after a disputed crash a few years ago. I questioned the existence of the witness as nobody else stopped, miraculously they were never mentioned again (and I won). If insurers clamped down on this sort of thing and treated it as attempted fraud then surely it would decline but until they do, people will keep trying it on.

Not sure a dashcam would be able to tell how many occupants were in the car that had run into the side of you.

However, as a police officer was I'm attendance, it's a big risk to lie.

Did the airbags deploy do you know?

If so, surely not hard to work out that if only one airbag went off no one in the passenger seat? (lets face it, if there were 4 in the car, three wouldn't sit in the back seat and be cramped and leave a seat in the front free would they?)

The insurance industry gets kickbacks from the process it then puts the price up to cover the costs. It is basically win win if they pay out.

Currently going through the same with my FIL. He was at fault and just nudged the car in front. No arguing there and hands up for that... however the shunt was so small it didn’t even disturb the dirt on the back of 3rd parties car and only just cracked the front number plate of his car. We have since received claims for whiplash, and another internal ‘injury’ that saw him in hospital over the weekend . The worst thing is he works for the police (not a policeman though). Our insurers are still awaiting response from 3rd parties solicitors nearly 3 months on .

Good luck, these scammers should be jailed for 2 years as a lesson !
