In yesterday's mail was an NIP from Lincolnshire Police. Turns out my OH was clocked doing 35 in a 30 but in my car, and - even worse - 'doing me a favour' by taking it for an MoT test!

In all probability it'll be a SAC, so the options would appear to be:

1) Do a 'Huhne & Pryce' and take the rap for her

2) Name her as the driver, but offer to pay her some proportion (up to 100%) of the SAC price (£90)

3) Name her as the driver, tell her to be more careful, and to take full responsibility for her actions

So what to do - remembering that it was, of course, all my fault smile

It was all your fault.... do the honourable thing & take the rap for her. Life will be easier in the long run

& charge her an admin fee for the inconvenience of you having to fill in the NIP.

People have ended up in far worse situations with the law by following 1. Sometimes they will have video / photographic evidence of who the driver is so if they see someone named as a different gender they'll surely investigate further.


Personally, i'd go with 2

3) of course.

A few years ago, my wife came back from shopping ‘be careful there is camera van in next village’. So out I went later, travelling carefully, and saw the van. A week later, the NIP came, we reckoned the time stamp meant it was her, 36 in a 30. SAC and the first and only time she has had a motoring offence (...that was detected!)

4) Nominate the driver. Pay £100 fixed penalty. Waste half a day on a course next time.

If she was driving and speeding then it's her that needs to go on the SAC not you! Whether you want to soften the blow for her financially is obviously your call but in terms of the list of your options above it's got to be 2) or 3). I don't doubt many people use option 1) but if found out it doesn't end well (as I'm sure Huhne and Pryce will testify!).

Yep, agreed.

Very unlikely you'd get caught out, but if you do then a ptcoj charge will seriously screw your life up, not worth it.

Out of interest to any legal bods out there - if you genuinely got the driver wrong (say 2 of you regularly swapped on a long journey) would you still be at risk of ptcoj?

Fair point but why would you do that? You'll pay more and have points on your licence (which will need to be declared for things like insurance purposes) whereas with the SAC you pay less, avoid the points and hopefully there won't be a next time (or at least not within 3 years!). The only thing I see against taking the SAC is it helps fund the model for the ever increasing camera van fleet....

My time is worth more than the price differential (if there is one).

SAC is declarable to some insurers. E.g. Admiral Group.

3 penalty points probably won’t make any difference to your insurance premium.

Save the course option for your 2nd or subsequent offence.

How high-maintenance does your missus have to be that it's even remotely preferable to perjure yourself than simply pass the ticket on to her?

If this is an already-on-nine-ban-avoidance thing, then the stakes are even higher when it comes to a lie.

As has been pointed out, 2) and 3) are pretty much the same!

I've agreed to take her holiday clothes shopping tomorrow afternoon and a nice lunch - at least it shouldn't be too busy....

There is always 5) FInd a solicitor who will advise you that there is little chance of a conviction...for a fee of course

She was speeding, doesn't matter where she was going or what car she was driving. Tell them she was driving and let her sort it out however she likes.

I advise all clients that if you’re involved then there’s no chance of a conviction.

A friend of mine thought he would get his mum to take a fine once for speeding.

Luckily for him, he requested a photo to prove who was driving and it was clear as day his ugly mug wearing a Chelsea football shirt !
