Bought a used car through Facebook market and we made a mistake.

On inspection we figured out there was something wrong with one part of car but we were not sure. We offered X amount but seller offered X + £500 with 6 month's warranty on if something major fault comes up in car. We accepted it.

On sale invoice which is on letter head of seller's company which deals with something other then cars, they wrote that car is sold for this amount and included 6 months warranty T&C. In invoice they didn't provided any T&Cs.

After 2 weeks this part started showing signs of a serious problem. On inspection from 3 garages, they all suggest it needs replacement as soon as possible.

Now spoken to seller they say warranty was only for car's tyres which obliviously not true as invoice is for car not tyres.
In advert they said car is in perfect condition and full service history, both statements were incorrect.

I read on internet private car sales, buyer don't have many rights, however I am unable to find relevant cases where seller provided written signed agreement with 6 months warranty. Is there a case for me ?

age mileage and price paid .

Any proof of the suspected fault discussions.

Is the seller selling other cars ?

There is no such thing as a warranty from a private sale being on PH you should know this, you've bought a car with a fault at the point of negotiation you either had to negotiate the price of the repair off or be prepared to pay for it yourself.

You're now in the position where you will have to repair this yourself, there'll be no other way around it, take it as a lesson learnt & move on.

Golf 2009, millage 110k, price paid £3000 went to garage, got quote for repairs around £1000

Seller is private seller.

Someone who knows about law a little bit said, we invoice has warranty included there can be a case on basis of breach of contract if seller don't agree to pay

No, Not exactly, doubtful but not sure which is why we had a contract with warranty

You say their business is selling something other than cars, is it motor trade related?

Tyres and Exhausts?

I only ask as you say he said the warranty only covers the tyres.

Has this person sold other cars recently?

Google the phone number to see if it flags up other car adverts.

If you have a proper invoice from a company saying you have six months warranty with your purchase then is it a private sale?

You'll need to get some proper legal advice, but if this company has given you a proper invoice with mention of a warranty on it, but with no T&C's then they've been a bit silly and left them selves wide open.

Some things you'll need to know though if you take it to court.

The court will take into account the price paid for the car, does it reflect a retail price, or one from a private seller?

Does the invoice say "private sale" across it?

Even if someone in the know tells you there's a chance you'll get somewhere it can go either way on the day.

You are supposed to give a dealer a chance to repair the goods, you may have to start by writing to them asking them to repair so you get a negative response in writing for the court.

I can't give you advice really without seeing the invoice, but unless they've written "private sale" all over the invoice then I'd say it isn't a private sale if you've got a company invoice with mention of warranty on it.

So you got £500 off of the price on the basis that there maybe something wrong with the car now there is something wrong you have £500 to find to pay for the repairs, so I say again get on with your life.
