Asking for a friend - who got snapped doing 80 in a variable speed limit zone that was 50 (m62)

Any thoughts on what I can tell said friend?

Be more observant of, and compliant with, speed limit signs?

Prepare for a large fine and either a driving ban or 6 points?

We've all done it, so getting a speeding ticket is a risk you take, although an indicated 85 in a 50 wasn't their wisest move..

We've probably all broken the speed limit to some degree, but we certainly haven't all done 80 in a 50 limit!

As above most likely six points and a fairly hefty fine.

Your friend is a fool. A variable speed limit zone is enforced by definition. If he's going to do 80+ in a 50 zone, do it in an area without a variable speed limit!

indeed, not sure about England but I recently got £400 fine and 6 points for 105 in a 70, thought I was looking at a ban, best advice I got was get a good lawyer and plead guilty as early as possible..though lawyer not cheap reckon it was cheaper than declaring to insurers a ban on the 5 cars in the family I am named driver on

Of course it’s helpful. If the OP’s friend follows it in future he will more likely avoid another six points and a ban.

If a course isn’t available then up to and including 75/50 would usually be a fixed penalty. However, 80/50 is too fast for a £100
fixed penalty with 3 points.

It’s 2018 so anticipate an SJPN / Postal Requisition rather than a court appearance. The Single Magistrate may refer to court or issue a notice of proposed disqualification or deal with it to a conclusion by imposing points.

There is no maximum ban, but unless the speed is grossly excessive then the guideline suggests a ban of up to 56 days or otherwise 6 points.

The outcome partly depends on how many relevant points OP had at the time of the offence.

Maximum fine is £2500. Starting point is 150% of relevant (net) weekly income. Plead guilty and you are entitled to credit. Usually one-third off the SP if entered at the earliest opportunity.

Wrong. There isn’t a starting point for ancillary orders.
