What does UK law say about that situation in general?

The question arises from this thread/case, If you want to address that situation as well great, but can we have the general case explained first.

In that case it appears to me that a technological point of fact has been missed, there is a real distinction between downloading and push technology. Downloading requires some deliberate action, but push technology in general does not, beyond installing an app to receive message.
