Bought a faulty car from dealer
Discussion
Greetings all
Would like a bit of advice, just bought a 1.1 Hyundi Getz yesterday for £1700... the cars electrics failed and was just able to make it home just as the car died, the battery had died. Also the hand break light stayed on all the way home and there seems to be a problem once in 4th gear the car seems to lose power for a few seconds.
Phoned dealer to complain about the car and was told to buy new car battery but was the told to bring the car back as they could get a battery cheaper, so charged the battery with a charger and the car started but only managed to get a couple of streets when it stopped again and was unable to restart it had to push it home. A friend called up the dealer on his phone as they seem to ignore the calls I made, he managed to get through straight away from his phone, he told them to come and pick the car up on Monday as its not fit for purpose which they said they would, he also asked for a full refund and was told something 28 day... will call them in the morning to see if they are coming for it...
What Id like to know is where I stand on this and how easy is to get my money back from the dealer... the car was for my missus after the car lost power driving home she doesn't want to drive the car now....

Hi ZX10R NIN thanks for replying so quickly
I was under the impression that if its faulty and had faults they had to refund if its within the 30 day window period, and after that period of 30 days they can repair or replace the car... they also replaced the factory fitted radio with a banged up one when they said the original just needed a code for it to work, I did call them a day before I picked it up and they said they got it working, they never mentioned they had replaced it with a battered radio...
Would the alternator cause the hand break light to stay on...

No you have to give the dealer a chance to rectify any faults, also if the light stayed on you should've driven straight back & pointed out that it hadn't gone out.I was under the impression that if its faulty and had faults they had to refund if its within the 30 day window period, and after that period of 30 days they can repair or replace the car... they also replaced the factory fitted radio with a banged up one when they said the original just needed a code for it to work, I did call them a day before I picked it up and they said they got it working, they never mentioned they had replaced it with a battered radio...

As for the radio again that should've been mentioned by you before departing with your cash upon collection.
The handbrake light is a separate issue by the sounds of it.
You don't have to allow the dealer a chance to correct the faults anymore, within 30 days you have a right to reject if there are faults that would not be expected of a car that age/mileage.
It may not be as easy as simply asking for your money back though as the dealer may argue their case, if it was £1700 it is obviously a fairly old car. What kind of dealer was it bought from?

Hi Nickp82
The car is a 2008 bought from a independent dealer, they are suppose to be coming for it today did call this morning twice the owner wasn't there either time so one of his staff answered the calls. The member of his staff stated that they would fix the problem of the battery, I did state that I wasn't interested in it being repaired by them I wouldn't trust them to do a good job as they sold it in the state it is... When they do pick it up hopefully today I'll follow them down with the paperwork for the car and hand it over to them, I'll tell them once I've done that I want a refund as I'm entitled to reject it with the problems I have with it.
Looked through the car manual as to what the hand break light staying on means... the manual states it because the break fluids is low... which is quite worrying as I drove it home.

I doubt that. The handbrake light will stay on because the handbrake isn't deactivating the switch / not fully released.
The brake pad light will stay on because your brake pads are worn out
The brake fluid level light - which it sounds like you're talking about - will stay on because the brake fluid is low.
