In a nut shell ordered some rather expensive glasses from GD by their standards. GD naturally sent these by recorded delivery. UPS failed to deliver them saying they left them in a safe place.

UPS won’t speak to us to tell us where this safe place is it’s that safe that I can’t find it I’ve looked everywhere. As we are not their customer only GD can raise a complaint.
GD couldn’t give a toss suggesting we phone the police who are going to do what? Track down the UPS driver and ask him where he left them and why he ignored their instructions to get a signature.

So where do we stand on this one? It’s been 20 years since I studied law but to me the delivery agreement is with GD and UPS who have ignored their instructions to get a signature and make sure they are delivered not leave them in a bin/shed/ bush. Anyone care to offer a more informed view?

You presumably used a credit card.

If so ignore GD and raise a Section 75 claim with the credit card company for failure to deliver the goods (they are jointly and severally liable).

Can't understand why UPS won't tell you where they left them?

They would know who the driver was.

Their policy apparently can’t discuss non delivery with us a dispute can only be raised by the sender. Paypal can deal with their appalling customer service now.

Just mentioned this to a UPS driver who I know and he said they are not allowed to leave anything anywhere without a signature, unless the customer specifically requests it.

Only saying what he said.

I ordered from them recently, I've just checked the dispatch email and it states this

"Orders for Boutique frames are delivered by a courier service and will be delivered next day (Monday-Friday) and will require a signature on delivery"

If they insist on a signature and the delivery driver clearly didn't get one I don't know how GD can be washing their hands of it.
