Since someone drove into me a few months ago, I've been getting quite a few cold calls relating to this.

How does this work with GDPR because frankly I'm getting fked off with it?

There are bonafide experts here, I am not one of them - but I have a passing familiarity. In summary / AFAIK:

1) You may have consented (potentially inadvertantly) to this as part of your contract with your insurer - you can withdraw that consent.
2) The call centre will likely be using the Article 6.1.f of the regulation where they can use your personal data (phone number / name etc) to pursue THEIR legitimate business interests where they don't overide YOUR interests, fundemental rights and freedoms.

I'll let you be the judge of the utility of GDPR in this scenario.

Thanks. Given that it's done and dusted (fixed/paid for etc), do they have any legitimate business interest?

No BUT they will say that they knew you had an accident and they can help you for a PI claim. I still get them and I can't remember the last time i had an accident.

Tell them when they call that you were found to be over the alcohol limit and see what they say. If that's ok tell them you were a banned driver on a provisional licence, with a drug habit, and no MoT or Tax, or insurance ,etc. hehe

Even if you hadn't had an accident, you'd still be getting cold calls relating to "the accident you recently had", I have.

Ask them:
1) What is the name of your registered company
2) have I consented for you to contact me

GDPR forbids companies to use data/cold call unless you've consented.

Yep I get these. Not had an accident.

Never confirm you have had an accident otherwise volume of the calls will only increase.

i had one of these call's yesterday. "you have recently been in an accident".

I replied "it was no accident, i meant to hit all them people. drove straight into them". That made the guy pause for a second, then i realised QCHQ were probably flagged. He didnt have much banter so i wished him fair well (F*ck off).

That is unfortunately not the case, GDPR allows companies to market based on their legimate interests, as long as they don't breach your fundemental rights. The more precise wording is further up the thread.

Love these calls ... well the very few that get through these days.

I just tell them that "It was very a serious accident, but I was the only fatality"

Some catch on immediately ... some need simpler english .... "I was bloody livid to find out I had been killed", "I was deaded"

Usually ends in us both telling each other to "Go Forth and Multiply" ............

I'm not convinced they do have any information on the claims, and are just calling people at random. Whenever they ring me I ask them to confirm my registration number, or my address, or even my name, and they never seem to be able to.

I'll try that one. Although, I just don't want the call.
