A friend of mines contract ended (phone was bought from CPW and network was EE) hence when he went to the CPW store they had sold a newer iPhone and given a new 2 year contract on the same network and number for £36 p/month

However when he came back home he found the same phone on a 2 year contract and with EE was £25 p/month,hence went back to the CPW store and asked to return the phone and cancel the contract

however they have refused saying that refunds are not for contract upgrades if it was bought in store but refunds will apply if it was an online order which is weird, the same story was repeated by their customer service dept too

Can someone please enlighten me on this as I fee that CPW is trying to pull a fast one

There's a set of "Distance Selling" laws that provide a degree of protection that buying in store does not.

In essence when in store you're deemed to have been able to make an informed decision as to what you are buying and agreeing to. Hence no refund.

When buying remotely, under distance selling regulations you clearly can't inspect the goods etc. so you usually have the ability to cancel.

I'm not sure what "cooling off" period there is with the contract, or whether this is extended under distance selling, but could be.

How are they pulling a fast one? If your mate is too stupid to shop around before signing the dotted line, that’s his fault.

It’s not down to CPW to give him the best deal, it’s down to your friend to check the deal is any good.
No cooling off period for contracts taken out in store either.

Sorry!

they did have bad press sometime back for misleading customers esp with TalkTalk broadband and also purposely delayed giving out PAC codes for customers wishing to leave at the end of contract

as for my friend well lets say he is not as smart as you mate smile

Its unusal as a long standing EE customer who up until a year ago could always get a good deal direct, for EE direct to be cheaper than CPW!

They would normally do me a special deal but last october CPW where cheaper on my upgrade.

What iphone did your friend get a iphone 6? or Iphone 7 @ that price.

In CPW defence last time I dealt with them they make it pretty clear that once you take an upgrade instore there is no cooling off period, online the distance selling laws mean they HAVE to.

CPW and TalkTalk separated many many years ago, and CPW don’t issue PAC codes - that’s the network provider.

I’m an ex CPW employee and I knew a lot of their deals could be had for less - I’m sorry but shopping around isn’t smart, it’s just basic common sense.
My apologies if this statement caused you, sorry your friend any offence smile

I think all the employees will be ex-employees within a year or two as all the networks will be getting rid of 3rd parties selling their phones.

Quite how the owners sold that business for what they did is beyond me. It is “aledged” that the whole business was founded and grown relying on the MTIC Fraud/VAT fraud in Europe.

As was proved in court a huge % of the phones they ultimately ended up selling originated in the VAT fraud lines. Of course, they did not know...how could they!!!!

Below are many many (a small selection!!!) articles and examples, of the largest fraud genre most have never heard of. Billions and billions a year for 20 years. So big, HMRC removed VAT on “wholesale phone trading”!!!! Welcome to MTIC Fraud 101...

Many for years “thought “CPW” was knowingly right in the middle of the whole thing and benefitted hugely. Made huge sums of money, drove the industry and relied on it as had no deals to buy direct from manafacturers....

I know Phones4u went pop, but I can't see all other outlets dissappearing. I'm sure the networks would love to have a monopoly, but that wouldn't be great for the consumer. I like getting my apple stuff from John Lewis SIM free.

Sorry, I meant the operators want to sell to the subscriber direct. i.e...look at all the EE/Vodafone shops on the high street now. CPW and the others are just resellers...

I've not needed or wanted a new phone in over 2 and a half years (Galaxy S7), but when ever i have in the past then i'd buy the phone outright, then shop around for the best SIM only deal

Horses for courses. I do the same. Bought a secondhand iPhone 7 a few years ago. Got a monthly sim only deal with Vodafone. A tad under £17 a month gets me 20gb data and unlimited calls and texts.

I still wouldn’t knock someone who didn’t fancy shelling out for a phone up front although I do baulk at the monthly cost for a new iPhone X on contract. Just had a look and it’s around £60 upwards.

I don't see how upgrading is a con? If you want a £500 - £1200 iphone for just 69 a month so be it.

If you have the means and prefer to buy the phone outright great, but doesn't mean paying a little more over 24/36 months for a subsised hanset is a con.

I have up until last year been happy to pay £5-£10 or extra a month for a new iphone every 2 years (3, 4, 5, 6, 8 plus) with little or nothing up front.

However with apples lack of innovation since the iphone 6/6s leading to a drop in sales it seems they have made the phones less attractive to upgrade to and just pushed prices up by in some cases 23% to protect revenues.

I prefer IOS to Andriod and as with most apple customers have invested in the eco system with watch, ipad etc. So just binning my iphone and getting a andriod phone isn't easy as my other device work together.

However my Iphone 8 plus and Ipad pro 10.5 will most likely be my last as I am no longer willing to pay the constantly inflated proces with very little in additional features. The new 11inch pro is £200 for the same spec with face id more!

Selling the XR as the most advanced display is a insult as its no even 1080p and has a lower dpi than my 8 plus!

Your not comparing apples with apples.

The phone sim free you claim is £350 maybe second hand (off the back of lorry?!?!) Thats a £700 phone they go for around £500 on ebay.

The contract includes line rental which you don't get sim free.

The sim will be worth around £20 a month so over 24 months which is what most contracts are now thatr about £240 so plus your £590.

So you save maybe £210.
