8 years of driving carreer. first parking fine.

I live in block of flat, which requires permit card to be shown, but mine is on the floor in the car. Site office has my car regiseration on thier paper.

they put on "Mini Cooper" on fine paper but mine is not cooper.

there is 0.50p a min phone call.

Can i get away with not paying the fine by saying its wrong model and the permit is on the floor of my car?

What shall I do?

Is there no address you can write to? If there is, I would just write a note saying it was displayed but that he must have missed it. As you have a pass, I would imagine they would to give you the benefit of the doubt.

Was this issued by a private company or by the council??

If the ticket was issued by the council than I would appeal on the grounds that you did display your permit and hope for the best.

However if it's the other I think it's bloody cheeky of them to charge you 50p a minute so you can tell them you have a permit to park there,other than that I haven't got a clue what you can and can not regarding a privately issued ticket.

Phone them up, tell them you have a permit and whoever gave you a ticket is a monkey.

Charge them for the 50p per minute, plus interest, plus cost of your time at, ooooh, £50 per half hour or part there of...

Tell them that you do have never owned a Mini Cooper, and as such, they have the wrong vehicle.

Can a legal eagle back me up here?

If I remember correctly a parking ticket on private land is not very enforceable (see Apex building in Reading thread somewhere). It has to go to civil court etc.

Of course, if your car is clamped on private land, this is a different matter and you have to pay up.

EXCEPT

The law regarding clamping has changed and everyone must be a qualified clamper, and only 10% of companies are currently certified.

SO

Don't pay!

When we got a "fixed penalty notice" from the private contractors at Bedford Station car park, despite having bought a ticket, we wrote to them telling them we had a ticket and weren't paying, and if they didn't like it we'd see them in court. We got a letter back saying they were dropping the penalty and not to do it again.

So, I'd tell them to knob off.
