It's legitimate interest, no? You bought a widget from me before so I thought you might be interested in this year's selection of widgets.

What's the practical verdict on this? How are we applying GDPR in this scenario?

Is it B2B or B2C? Potentially you could use LI for both but email falls under PECR and you need to have explicit consent to email B2C.

It's B2C.

Sorry what is PECR?

Privacy & Electronic Communications Regulations. It wasn't replaced by GDPR and has been in effect for many years. It sits alongside GDPR and the Data Protection ACT.

Essentially it says that for B2C electronic communication, which includes email, in the UK we operate on an opt-in basis. This means you need explicit consent before emailing anybody.

Because they are ex-customers I don't know what impact that has and whether you got consent when they originally bought.

More info can be found here https://ico.org.uk/for-organisations/guide-to-pecr...

The ICO is also a very good resource to call and ask questions.
