HELP PLEASE: Pulled over for speeding
Discussion
Hi guys,
So absolutely bricking it after being stopped by the police yesterday for speeding. Would really appreciate any advice on what could happen. Apologies for the lengthy story in advance!
Please note this is not an excuse for my actions, rather facts on what happened.
So I was driving down a 50 limit dual carriageway when a car behind was speeding up to the tail of my car to the point where I could not see his headlights. I moved over to the left lane and he done the same thing to another two cars in front.
After then getting to a roundabout and exiting on to another 50 limit dual carriageway, the driver started doing the same thing again to me, speeding up and tailing my rear so close that I could not see his headlights. I really do not know what on earth he was doing and he had his wife and a kid in the car!
So at this point I decided to put my foot down to get away from this tw*t and sped up to about 70-75mph. He then sped up to get on my tail again! At this point, the blue lights came on and we were both pulled over.
The officer told us both to get out of the car and join him on the foot path. He proceeded to read out our rights (any thing you say may be given as evidence in court etc...) and then proceeded to have a go at us. He said we have committed three offences, speeding, dangerous driving and not sure what the last one was. I apologised for speeding and accepted responsibility for my actions but made the officers aware of what this driver had been doing. The second officer admitted that he seen the other driver speed up and tail me which is why he told his colleague both of us had to be pulled over and not just myself.
Now after having a go at us, the officer did say something along the lines of being lucky because he had to go attend a robbery. The other officer done some checks on the vehicle (insurance etc) everything tied up and we were told to get on our way.
Now it seemed like I had been let off, but thinking back to the officer reading out the rights, would this be classed as a verbal notice of intended prosecution? He did make a quite a few notes in his notebook as well. What would be likely to happen at this stage, could I be receiving a court summons or fixed penalty?
Just to add, I already have 6 points on my licence for speeding (overtaking a lorry at 51mph on a 50 road which turned into a 30 for a few hundred yards and I happened to get a flashed at that point unfortunately).

Did.
I think you’ll just have to wait, but I seem to recall it’s possible to find out if there’s a prosecution coming. Others will advise.
In future, please don’t speed up. Just slow down gradually, let them overtake and go on their way. Too many knife wielding thugs out there to go making things worse.
Good luck!

I'm confused OP. You say you pulled over to let him past and he then tailgated two other cars in a similar way to you. How did he then get behind you again after exiting the roundabout? Also, he had his wife and kid in the car that pulled you over?
Have I misunderstood what you posted?

If there is a way of finding out it would be great as now I’m going to sh*t myself for the next 2 weeks hoping nothing comes through the door. I think you’ll just have to wait, but I seem to recall it’s possible to find out if there’s a prosecution coming. Others will advise.

On the initial dual carriageway when he was tailgating me, I moved over to the left lane. He then done the same to two other drivers but couldn’t not get passed them in the right lane as they did not move over. Have I misunderstood what you posted?
I then exited on to another dual carriageway which he also did which is when he started tailgating again so I sped off. Once i gathered a considerable distance, I slowed back down to the speed limit; however, seen him in my mirror speeding towards me again right up to my tail. Absolute d*ck of a driver!

Sounds like you were given a verbal NIP. Not a two week wait, they have up to six months to get it processed at court. I think that's unlikely though as you'd be given some paperwork, and for dangerous driving be interviewed most likely.
An NIP can take a little longer if your car is owned by a fleet management company as they have to find out who was the driver of the vehicle, so it may be a couple of months or so before the letter through the door with your surname in CAPITALS in an A4 envelope
Looks like 6 points minimum, or if you are a new driver, 12 month ban, especially for dangerous driving. If you're being tailgated, always pull over and let them pass.

He was apparently charged with multiple offences at the roadside, so nowt to do with NIPs. 6 months to lay it before a court for prosecution; sounds like a long wait for the OP...

That doesn't automatically mean that you will face prosecution, but you might, the authorities now have up to 6 months to bring a prosecution against you, so you'll have to wait and see.
As far as the officer is concerned, what he has seen is two cars racing each other on the dual carriageway, in excess of the speed limit (it may be the case that you weren't really "racing" the other car, but that's how the Officer would have seen it)
You say you were driving along the dual carriageway at the legal 50mph limit, when a speeding car came up behind you, sitting right behind you, so you pulled over to the left hand lane to let him go on his way (which was the correct thing to do).
You then say he did the same thing to two cars further ahead, so basically he was just bullying people out of his way.
After that, somehow, the driver who was now ahead of you up the road, ended up behind you again after a roundabout (I suspect the driver had taken a wrong exit on the roundabout, turned around and ended up behind you again), and then proceeded to bully you out of their way once more.
This time however, rather than doing the right thing and simply getting out of the way, you've decided to speed up to 70~75mph in the 50mph limit, and try to outrun the other driver, because you'd got it into your head that the other driver was deliberately targeting you for some reason. That makes no sense at all, because all speeding up will do is increase the danger involved, and as you had already seen, if you got out of the other drivers way, they simply went on their way.
You may have genuinely misread the situation and made a poor decision to speed up, or your might have simply decided to be pig headed and refuse to allow the other car to get past you once more, choosing to race them along the road , only you will know the truth on that one. Regardless of which one it was, you're bang to rights on the speeding, so bad luck if you get prosecuted for it.
Here's a handy tip for you: The next time you find a car behind you driving faster than you are, sitting on your bumper, driving like a tw
t - Simply let them go and don't get involved with them! If need be, find somewhere to pull off the road and let them go on their way!(When I owned my Ferrari 348, I was often plagued by tw
ts in Focus ST's, Integra type R's and such like, who would try to goad me into racing them, and I never took the bait, I simply got out of their way, and let them bugger off and go and annoy someone else. On one occasion, this involved me having to pull into a pub car park and wait for a few minutes to resolve the situation safely. That to me made far more sense than getting into some pointless road race that could have ended in disaster at any time!)4rephill said:

I thought the OP was going to say it was the police car doing the goading - GMP had a reputation for doing that until people got wise to it.

I assume it's standard practice to ensure anything said from the moment you get in the car is admissable as evidence.
If the guy said that "you're lucky I have to go to a robbery" then the likelihood is that you got off with a warning. That statement wouldn't really make much sense if you were still going to be prosecuted.
As has been said above however the caution is the verbal NIP so you have around 6 months to see if anything comes of it.

Never ever wanting to lower myself to their level I'm perfectly happy to slow down & make it real easy & thus no challenge for them to overtake me & I'm absolutely prepared to pull into a lay-by or whatever & let the prats go on their way. Their self obsessed impressions of being superior or needing to show-off are thus utterly lost & my actions intentionally communicate that their puerile juvenile behaviour is beneath my contempt & is of no consequence.

The question is whether you were actually cautioned or just checked and had your details checked.
If you were correctly cautioned he police officer would have used the correct form of works to the effect that you would be reported for consideration of proceedings for the offence(s) of ..... and that you were not obliged to say anything but .....................
Should those words not have been used you could still receive an NIP, but it would have to be within 14 days. If you were correctly cautioned there is a 6-month period in which a summons can be issued.
If he said that you were lucky, it sounds as though you have got off with a warning.
