Agencies Advertising Non-Existent Jobs

Last October I spotted a nice little job on Indeed with a firm who manufacturer and distribute work textiles/clothing/consumables/mats etc and as they have a depot local to me I applied for a 3.5t van driver job. the ad was through an agency and they acknowledged my application and said they would be in touch.
months on and still no interview or "unsuccessful on this occasion". they have sent me 3 emails saying that the company are still drawing up their shortlist for candidates. The advert contained the company logo.
Anyway today I went onto the company website to see if I could get any info from that. No jobs advertised on the careers section so I have emailed them directly under the contact button and explained what has happened, the name of the agency and I have asked whether this agency has been appointed to act for them and whether in fact the jobs actually exist. I also asked if they had permission to use their official logo if they had not been appointed to act for them.
If the company takes it up with the agency and they get hauled up for misuse of information and breach of copyright etc then so be it. I am sick to the back teeth of applying for vacancies that turn out to not exist.

Well theres a turn up........just got an email reply from the company in less than 15 mins!
The email is from the actual guy who put the adverts for jobs together only he admitted he has not had time to look at every application.
He noted where I lived and asked if I would be interested in vacancies at location A or B and as it happens I am close to both so I have replied saying I can be flexible between either depot.
I honestly thought the agency was using their details without permission simply because it had been dragged out for months and now I feel a right old cynic.
Anyway if I could get in at location A its literally 5 mins round the corner by car that would be superb........
