Earlier this year whilst enjoying an early morning drive with other enthusiasts in the more rural areas of an ex colony of the UK, we were caught with a radar activated camera allegedly exceeding the speed limit.
The NIP arrived within the 2 weeks with the form requiring driver identification. However, the date on the form was the day earlier that we were driving in the area.ie the wrong date.
I sent back the form, requiring the driver to be identified, signed as I am the undisputed owner, but without the drivers particulars because the car was parked all day on the date the police say we were speeding.
The police have returned to me the original form with a hand written note insisting that I complete the form and identify the driver.
The police have also phoned and again insisted that I identify the driver. It seems that the penny has not dropped in that they are requiring me to identify the driver on a day that the car was not driven.
Although the laws are a little different to the UK's they are still basically the same.
Any ideas?
Can they still prosecute if they have the wrong date and the statutory period of notification has elapsed?
Should I claim that I never received the original form, it was not sent by recorded mail.

Hang on, do you reside in the UK, and are being chased for a foreign offence?

Or do you live in the country of the offence?

Any chance you could prove the car was parked up all the day on the paperwork? If so, a polite note explaining this would be in order, and stating that there was no driver, and that this would appear to be a case of cloning of plates etc.

Cross fingers that the date is assumed correct by all interested parties, and bingo.

Thanks for the replies guys.

I do not live in the UK and live in the country that the ticket was issued.
Bit difficult to prove cloning plates as my car is one of only 5 here and apparently the photo shows some unique features on the back of the car.

Obliterate the unique features and then argue with em...
