MOT question???!!!

Last year my car passed its MOT on 28th Feb.

I took the car to get the MOT done yesterday and it failed (EGR valve not working properly = Engine management light on = fail). I have 10 working days to get a free re-test at the same MOT centre.

Questions:

- Does this mean the car now has no MOT (as it failed yesterday) even though the MOT last year is still good for 7 days ish?
- Can I drive the car to another garage to get the EGR valve fixed or is the only driving allowed to get an MOT/MOT retest at the same garage the did the test yesterday?
- Can I drive until the last years MOT runs out or is that now legally void as a subsequent MOT test failed?

The guy who will fix the EGR valve cannot get my car MOT'd! I want to drive to get the EGR valve done then drive it to the garage that failed it for the free re-test...

Any help appreciated...

Answers below to the best of my knowledge, but I'm sure they will be thrashed out over about 10 pages

It still has an MOT until the original runs out

Yes, allowed to drive anywhere you would normally, unless failure is "dangerous".

Crossroads for thread topic: the car was already illegal to drive if it had a fault making it dangerous. The difference is that after an mot you couldn't argue you didn't know about it.

Yes, you can, and No..the old mot is not void. But driving a car that is unroadworthy / dangerous "trumps" whether or not your mot certificate is valid. So the MOT is a secondary issue.

But in your case, I doubt a failed egr is dangerous, so there isn't a legal issue with you driving it anywhere, until the original mot expires.

The car's MOT remains valid until the expiry date shown on the original certificate.

With the failure items as described, you can continue to drive the car as normal.

The car's current MOT is not voided by the recent failure.

I'd say leave it here as it will stop others from asking the same question, or asserting the opposite is the case.

Strictly speaking, would it not constitute a constructions and use offence to drive with a defective EGR valve?
I.e what "could" happen if DVSA pulled over the OP and done a roadside test and discovered the fault?

I know realistically that's never going to happen, hence strictly speaking.

As far as I know you can drive a car to or from MOT repairs regardless of whether the car has a valid MOT or not.

Just to be anal; you can't drive it away even with a valid MOT if after testing a ‘dangerous’ fault was found.

Just to be really anal, you most certainly can. They have no legal power to withhold your car.

Agreed - you run the risk of commiting a Con and Use offence but that's all
