Hi all

Background - no excuses just giving info.

Driving through a 40mph behind two slow lorries road goes from a single to dual carriageway - still 40mph limit for about 500 yards before turning into NSL limit.

As we hit dual carriageway both lorries immediately pull into the left lane...unusual i think as most continue in fast lane as there is a filter lane allowing those turning left onto dual carriageway to come on. Then I realise why...speed camera van parked up just before NSL sign. Immediately gets me as I put foot down to pass the lorries.

I'd just arrived home from America and had been up for over 24 hours....no excuse but that's the reason the foot went down. I was passing lorries coming onto a dual carriageway and the foot went down early (desperate to get home).

background out of the way the notification came through today of intention to institute proceedings against the driver for the alleged offence. Offence - doing 58 on a 40mph speed limit. Backed by photographic evidence.

Never had any speeding/motoring offences before. 1st offence of any kind on my record. I am a Police Staff Member. I do not need a car for my job.

Is it likely that I will go to court and get done for Dangerous / Careless Driving ? I'm happy to hold hands up and take the points/fine...but unsure if i should currently be getting legal advice.

Do you think this will impact my employment? I don't have to have a clean licence for my job but If i do get done with Dangerous/Careless Driving I don't know where that would leave me.

If it helps anyone giving advice it is Scottish Law.

If it were England then it would be too fast for a course but within the threshold for a £100 fixed penalty with 3 penalty points endorsed..

I would not expect that a single speeding conviction will affect your employment.

I doubt that 58/40 is sufficient for careless or dangerous driving - even in Scotland.

Thanks for your thoughts on this.

I don't intend on challenging anything and I'm happy to hold my hands up and accept fine etc. I would however challenge if they decided it was dangerous/careless - mainly because it was dual carriageway and they were sat right before an NSL sign. Would need to challenge because of employment - I would think a conviction for Dangerous driving might see me punted.

Been with employer over 23 years so hopefully my clean working and private record will count for something.

You're panicking about nothing - fill out the NIP as advised and follow the instructions. There is no reason you would get another conviction for a simple speeding offence

Thanks guys :

I believed from the outset it would be points and a fine...but didn't realize I was at 58 in a 40.
Seriously doubt if points on my, currently, clean licence would cause problems with my employer.

Again thanks for thoughts.

It will be a fixed penalty, 3 points and £100 fine.
I got mine on Monday,62 in a lonely country road that was a 40, sent the cheque off yesterday.
