From the trackday forum. If attending an Easytrack trackday:

""5. I agree that any images, moving or still, that I or any person attending as my guest, make at the event remain the property of EE(UK) Ltd and are for my own personal use only. If any of these images are used in any commercial enterprise, publication, broadcast or any other form of public media I agree to pay EE(UK) Ltd the sum of £25’000 per instance and any fee levied by the circuit operators. " "

Enforceable? Does this mean I cannot post any pics I take should I go to an Easytrack day? I guess so....

I've put up thousands of ET pics, posted about them on their forums and listed them in their gallery without any problems.

They do have a commercial arrangement with a particular firm but there has never been an issue for me with either ET or their official photographer with posting images for non-commercial.

One assumes that barring the words "easytrack" visible somewhere in the image it would be impossible to prove an image was taken on an easytrack day in the first place, unless you left the EXIF information in there.

Fair point; unless you put up a post saying "buy your Easytrack pics from *date* *venue* here" then it'd be tricky to prove EXACTLY.
I was more interested in the whole photgraphers rights side of things - its your image so you own it, not EE but of course the implication is exactly that. How can they lay claim to an image you produced?

you own the pictures if they are taken in a public place. But if you go to a private venue then you may have to agreee to certain T&C in order to be allowed access. they are allowed to state whatever terms they want - if you don't like it then you can't go!

I've discussed this with Goodwood in particular they told me the "official" photographer of the TDO is allowed to sell directly to participants but not to the general public. Spectator photographs are fine for private, non-commercial use.

This is in the T&C's for Goodwood, I'd imagine most other circuits are the same or similar in that they retain their own rights.

Photography and advertising policy : Goodwood Road Racing Company Ltd holds the sole commercial photographic and filming rights for the motor circuit and airfield and no such activities are permitted unless previously approved by the Company.

Still and motion photography is permitted only for the purpose of providing memorabilia of the event taking place. The organiser shall ensure that any photographer in attendance (unless directly licensed by Goodwood) has signed the Goodwood Indemnity (see Part 6). Any invitee wishing to take photographs for commercial purposes (including sale to Participants) must seek consent from Goodwood and sign Goodwood's photography consent form.

Advertising to the public is not permitted. The use of 'Goodwood' must not be included in any event title, although the event may be given a name including 'at Goodwood' used as a suffix.

Marcus was probably just in a bad mood - he's used several of mine from EasyTrack days for ads in Autocar etc, and simply asked my permission. (He probably ended up in the gravel again, you know what he's like when he gets one on).
