mobile plods on M6 toll

Just a quick warning, yesterday heading north on the M6 Troll, on the hard shoulder was a marked police car with the passenger pointing a speed gun towards the oncoming traffic, from behind his door.
I doubt he got me as there were about 3 billion cars between me and the camera, and I was in the fast lane doing about 75-80ish.
Still, it was a very silly place to park up and aim a camera at cars. Very busy, and the operator would have been dead if anyone had hit the car.

Ive said it before and I'll say it again the I see more Police on the Toll road than anywhere else.
I go past 3 junctions on the way to work and regulary see marked cars go on and off. I have also seen an unmarked black Jaguar pulling cars over and regulary see marked cars hiding on various service ramps.

At least one. I saw a car in a field a couple of hundred yards from the hard shoulder, on its roof. That must have stung, and it probably didnt help with the speed argument.
I doubt speed was the cause, it isn't usually. (Only about 3 to 6% of cases and that's probably a bit of an exaggeration.)
I saw that one as well Parrot, he was parked just after a left hand bend. You could see something was up because I saw the brake lights on 6 or 7 cars come on at the same time where the bend was opening up - that's safe isn't it!
I was still doing about 82 as I passed him but there was loads of cars between me and the hazard - sorry, I mean the officer.

I think I read elswhere on this site that a plod parked half on the pavement and road, was parked illegal and therefore motorist caught speeding by the occupant were invalid.
How on earth can a police car be parked LEGALLY on a hard shoulder of a motorway carrying out speed checks.
Doesnt the highway code apply to them?, guess not if they can road test their cars at 159 mph etc etc.....

I believe the police don't pay the toll fee so I suspect given a free choice between an empty motorway and the M6, the toll will always win in the race to the to the donut shop.
The reason it is empty is that most people realise it is a con and what it will bring. Sending it bankrupt is the only solution.

I think you're quite right Parrot; but consider this.
Technically, this is a private road.
Do they have any right to be there?; is it legally appropriate for the police to enforce road traffic laws on a private road?
Surely if the owners of the road want to enforce a speed limit they would have to do it through the civil courts?

Standard RT Act rules apply, all laws enforceable, therefore Police allowed to carry out their duties?
I honestly don't know; I hate the whole concept of the thing.
I would rather walk than pay any more money to a use the roads in this country.
But the crux of the matter is, has it been tested in court?
Has anyone stood up and said simply, "If I am paying private money over and above road tax to use a private road, I am entitled to travel at a speed I consider appropriate!"
I reckon you'd have a good common law argument.

It may well have been privately funded but it remains a "road" under Road Traffic Acts. Sec of State will have made an Order saying that it is the same as a non Toll Motorway and rules apply. Cannot find that SI at the moment.

It is not and never has been a private road. The road is owned by the crown and all the laws of the land apply.
The road is the first "toll" road. Historcially the crown built and maintained roads, then it paid someone to build the road while it maintained it, then it paid someone to build the road and also paid them to maintain it. This goes one step further and the crown contracted someone to build and and maintain the road but rather than paying for it, allows Midland to charge the users money.
Clearly the taxpayer will step in if the midland go under because the taxpayer owns the road. What is important that a clear message is sent - motorists pay billion in taxes and do not expect to pay more through road usage.
If you don't - GPS tracked, pay per mile is no more that 10 years away. It is coming, the papers / discussions documents are in place, the policy is in place, and the Satellties are being launched.
So what you say? How about £1.75 per mile - everymile, pop to the shops - £5 thankyou. Thats the top tariff proposed.
