Bought a car dispute about ownership and v62

So I’ll try and keep this brief. Basically, a bought a car for 5k. The guy had just split up with his wife and not divorced. He paid for the car outright and his name is in the logbook. He also bought it as the was splitting up. He gave me a recipt, both keys and both his addresses (his old one and his parents were he lives now). Now he couldn’t get hold of the v5c as his wife will not hand it over as she wants half the money. I have done all the relevant hpi checks and it’s totally clean and legit. But now as he can’t get hold of the log book, I can’t tax it, and I have had to send a v62 off, which is going to his old address were his wife lives.

I’m not totally sure what to do if I’m honest. The car was a total bargain (bought it damaged) but I don’t want to start getting into legalities. I do have her address so I thought about going and trying to reason with her? Or is it just a case of waiting for the v62 to show up?

Obviously this v5c isn’t proof of ownership but it’s still making it very awkward for me. Also he left it taxed and I drove it back, on my insurance. So technically speaking who would be fined for no tax if I went through anpr camera?

I suppose the question is how much would you pay her for the V5

If she is mental though you could end up in a lot of bother too

I did suggest I would actually give her some money for the log book to the guy but he didn’t want her getting anything, might be a possibility I guess.
What bother could I get in exactly? Is it worth chasing, leaving or see if I can get my money back?

It's good you have a receipt. I'd stay away from the mental wife and phone dvla up instead. Provide them with your address.

You did everything you could to satisfy yourself that it was the guy's car to sell. You've paid him, and the car is yours.

Per the DVLA website, the seller needs to do the following:

Fill in the log book and post it to DVLA. You’ll get a letter within 4 weeks confirming you’re no longer the keeper of the vehicle.

If you do not have a log book you must write to DVLA with:

your name and address
the vehicle registration number
the make and model
the exact date of sale
the name and address of the new keeper
Your notification can be rejected if you do not give all the information. This will also affect any vehicle tax refund you’re owed.

If he's done that, you should be getting a V5C through to your address, in your name. I'd ring them up and check that it's in process, if I were you.

While this is not strictly legit because it was taxed it will not ping the ANPR cameras so rest easy

Right, so bit more info on this one. I messaged his ex just after writing this. She rung me and said she doesn’t know anything about this, but there is no log book at the house. Now I’m not sure if she’s telling the truth or not and she might intercept the v62, I guess worst case is 6 weeks without the car on the road. Still a ball ache but I feel a bit happier knowing I should be safe with my money. She confirmed the car come from stone acre, which matches up to the paper work and his story. Still hassle I don’t need

Thank you, I was thinking that but wasn’t entirely sure if I could pick up who it was insured with and see it didn’t correspond with the keeper. Thanks

You could have taxed the car with the V62. I bought my current cat without a V5 and I just taxed it at the post office on the V62 (while paying foe that).

The V5 then turned up a few weeks later.

we sold an old car last month couldn't find the v5 new style anywhere so I wrote to DVLA as suggested above , no issues and the new owner taxed it the same day as it was sold with a v62 at a post office . I got the letter from DVLA a couple of weeks later saying it had been transferred no issues at all.

I bought a car last year from a trader who was selling the car on behalf of the owner. They had lost the V5. I was dubious and quite nervous as I parted with £5k.

Used trade plates to get the car home, then took it to the post office the following morning and taxed it for 6 months with a V62.

The V5 did take some time to come through though but chased up the welsh clan who were pretty helpful.

There was a error with the tax when I tried. I think it’s because he hasn’t notified the dvla about this?

DO NOT try and tax it without a v62 or new keeper suppliment, otherwise the tax will be attributed to the previous keeper and then refunded to THEM when the vehicle is transferred into your name.

As the people who sold me a car recently found out, having not changed the name on the logbook to "keep the number of registered keepers down" (yeah, right) and then taxed it. When i bought it and registered it in my name online......the previous keeper got a nice cheque for about £300. Bet that cheered him up :-)

I think the dvla write to the keeper and notify them of the change! Although they hadn’t long been split up and are still married so maybe I think the car was registered to that address and that was his house. He is now living with parents! Both houses I have addresses to.

Yeh it’s pretty confusing now, if I knew it was going to be this difficult I certainly wouldn’t of bothered!

If you do that, the previous registered keeper will get a letter from DVLA to check that the request is legit. They will wait a week or so to hear back before issuing a new v5 (to stop people just decidjng to reguster cars as their own etc) so i suppose the concern is that letter goes to seller at ex wife's address, she opens it and contacts the DVLA to say no, no no this is not right etc.

Seller really should put a redirection in the mail to make sure the Ex wife does not get his post (relevant to more than just this). Might be worth checking if he has one in place OP. If he has, no worries.

Yes pretty much that. The wife could dispute it. However I have got recorded phone calls from him saying he was the registered keeper. So if she did do that I’m not sure what she could do. If it is a case of her wanting half of the money, it’s infruiating to be stuck in the middle of it.

Sounds like a right old pain in the bum OP. Hope you get your V5 without any further agro!

Have the same at the moment. Bought car from a dealer who filled in v62. Previous owner taxed till March 22 hasn't claimed the tax back so have to check online every day. Hopefully sorted soon.
