Seems that more Stringent rules now mean that if you pay for a Take away at a drive though window you could get 6 points on your licence for using a Mobile phone while "driving". Idiocy of this? Grab the Card reader and swipe it at your phone in the holder and it's not an offence. Much as I do not want idiots texting on the things or updating their status on the move it seems that sensible use of a device is out of the window in order to criminalise society.

Show me an actual verified court case where this has happened and I'll believe you.

If you are worried. pull up at the window, apply handbrake, switch off engine, remove keys, pay, start engine, release handbrake, leave. All perfectly legal then

You don’t have to go as far as engine off. Out of gear with handbrake on stopped in a safe place is fine. That’s a bit different to the type who rides the clutch as they reach into their bag for their phone.

The legislation is very specific; a mobile phone offence can only be committed "on a road."

Many road traffic offences can be committed "on a road or other public place" but this is not one of those offences.

But aren't most (if not all) drive through's on private land? So it doesn't apply?

Wonder what the thinking behind that is & how they define on a road? Is it the same for all construction and use stuff?

You use the Jimmy Carr defence, I would have thought. Isn’t the charge something like using a mobile phone as a communications device, which is how Jimmy beat the charge? Apologies if my memory has misled me! Assuming I’m right, it doesn’t matter whether a drive through is a road or not - you’re not using the phone to communicate, but rather to pay, and so you shouldn’t be charged...
