Hypothetically speaking if you were doing a give-away of another product to help shift your own then is there anything you need to arrange first legally?

For example, if you were giving free iPods to anyone who ordered your computers would you need to contact Apple? You would be including an image of their product and the name of it in your promotions.

Hypothetically, no. If the items belong to you, you can do what you want with them. However, it may be good ethics to contact your supplier and let them know what you are planning.

I tend to agree with M.A.M on this, but I'm no lawyer. I would add, though, that getting in touch with Apple might be beneficial to you as they may be prepared to supply you with things like suitable images to use in your campaign, free of charge.

Hypothetically, would your comapny have some kind of legal dept who could advise you on any legal implications of what you're planning?

Someone like Apple is a true custodian of their Brand - they do well becuase they control it so well. It doesn't mean that they won't mind giving iPods away, but you have to talk to them first as they may have a policy of ot devaluing the product by price reduction or promotion. Companies may also get a bit funny about what product you are promoting theirs with.

As a pie brand, we have an issue at the moment with the youth rugby sponsorship we have historically undertaken in Wales. Future sponsorship will probably not involve youth teams becuase we can no longer be associated with such age groups.

On the flip side we have a wonderful relationship with a soft cheese brand which we may want to cross-promote by including it in one of our pasty recipes.

Just talk to them - they may promote your business too!

Thanks for all your input, just what I thought it might be. At the moment it's just a thought which I may bring to the table at the next meeting but I wouldn't want to suggest it if there was some obvious legalities that I'd missed.

p.s. Legal Dept? I wish, I don't even have a single full-time salesman anymore

That's a good point - they may have budgets for such joint promotions.
