Solicitors Letter - Outstanding Energy Bill
Discussion
So, we have received a solicitors letter using the correct address, but addressed to 'The Occupier'. Its for an apparent outstanding energy bill that they claim bills have been sent out for (nothing received), and are ultimately threatening a CCJ if monies aren't paid.
Legally, where do I stand with this?

When did you move in? Sometimes bills meant for the previous occupant are addressed as 'The Occupier', I had them when I first moved in but rang the energy company and told them when I moved in and that I didn't have a forwarding address for the previous owner which sorted it Legally, where do I stand with this?

Does your case fall under the 'backbilling' agreement?

Sounds like a scam.
Give the energy company a call and ask for more information
The energy company are in administration.....Give the energy company a call and ask for more information
If so, it's the administrators who should be taking ownership of the problem. All a solicitor/DCA can do is chase.
Besides, if the creditor doesn't know who the debtor is, they'll have difficulty with issuing a claim (or getting their tame rottweiler to do so).
Probably not relevant. But had a long running saga with one of the big scottish based power companies.
I moved out of a house my then partner was still living in, after a while I closed the account, which was in my name only. The ex never set up new accounts before the house was sold a year or so later and which she continued to live in. They chased me for the money claiming there was a deemed contract in place. They wouldn't accept my side of events and chased me for around 3 years with loads of threatening letters with ever increasing debt amounts. Eventually I just said I'll see you in court. Miraculously they closed the file down soon after but did put a mark on my credit file, which I've never been able to remove.

Is it really from a solicitor or one of those pretend ones?
Cant have a ccj without going to court.
Plus you ONLY get a CCJ Cant have a ccj without going to court.
1) IF you go to court
2) THE court says pay
3) You pay within the allotted time
4) Equal NO CCJ
OR
As as above but
3) you dont pay within allotted time
4) YOu get a CCJ
I think that is the simple explanation#
