Policy expired 23:59 on 27/09/19. I was of the genuine belief it was tonight instead.
Flagged on ANPR tonight about 6pm. Car seized.
Both TOs advised they have never encountered such a quick flag. Have offered to document full explanation re circumstances. They even confirmed that it was showing as valid on yesterday's records so they knew it was a genuine mistake.
What am I likely to be looking at punishment wise? Also rough costs for release of vehicle if possible?

Positive, officers checked whilst I was sat in their car.
Said I can insure and collect on monday but did not mentioned amount of fees etc...
I have not accepted a roadside ticket. I discussed it with the officers and they suggested I may get lucky once they submit all the details or i may just get the same offer of 6pts and £300 fine.
May i get lucky?

Did you not get a renewal notice from your insurance co. Most auto renew nowadays unless you told them not to and it seems like you haven't changed insurers.Flagged on ANPR tonight about 6pm. Car seized.

You might get lucky but at the end of day, driving without insurance is absolute offence. Your circumstances is that you forgot to reinsure.
I doubt you'll get lucky, it is what it is.You will now need to get insurance cover as soon as possible. You will need to ensure that this insurance is suitable 'compound insurance', ie that it will be able to get your car released from the compound. Be honest with your new insurer about the fact that you need to get the car released from being seized.
Then you'll need to attend and produce your documents and prove your insurance at the nominated police station for the area/county in which your car was seized. They will check everything is satisfactory and stamp the form to say it can be released back to you.
Then go to the compound where your car is, produce the stamped form and photo id (driving licence or passport), pay the charges and drive your car away.
The recovery charge will be £150 (assuming it is a car), the storage is £20 a day and if it was seized today (Saturday) the storage charges will not start until noon on Monday.
So basically get it all sorted on Monday morning!!!
I received an email yesterday stating my auto renew due on 28th had failed, insufficient funds in my account.
I thought this meant it was fine for today, inwould have been renewing tonight anyway as I bloody knew it was due.

What would I be asking of the insurance company re backdating?

I have known this happen in the days' of a HORT1/2 being issued and the person a motorcyclist found out the policy had just lapsed. Flagged on ANPR tonight about 6pm. Car seized.

They went to their insurance broker HORT1 in hand and told them what had happened.
The broker said no problem we can back date your insurnace from your renewal date. We would have done it up to 2 weeks expired!

No you haven't. You've misunderstood what they were offering/saying. Insurance companies do not offer to commit a serious criminal offence in order to win back lost business. Driving without insurance is 6 points and a fine. Backdating insurance cover is prison time.
Excuses for being pulled for no insurance are generally pilloried on PH

Spoke to insurance to haggle renewal a week or so before expiry
For reasons which have never been explained the transaction did not go through
They had often spammed me by phone, text and email for life and house insurance but absolutely did not tell me by any of these modalities that my policy had not been renewed
I was pulled shortly afterwards by the worlds nicest traffic cops who let me sort roadside insurance instead of confiscating my car
Purely because the tossers had all my details I phoned my ex insurer for a quick policy fix who I kid you not gave me a discount which was in the same ballpark as the fine for not being insured because I was a new customer
The IN10 is not something Im proud of however moderated my driving and attitude to motorway speed limits and 10 years down the line I still drive 10% slower but arrive at my destination only marginally less quickly and a whole lot more relaxed
Admittedly traffic lights changing to amber are a huge stress on 6 points...........
The increase in insurance for a high risk car was significant in the first year but not disastrous
Years 2 and 3 were less painful
So baso it was a shocker at the time but didnt cost me that much in increased premiums and the difference in my driving has been maintained to this day

I think I would just call the insurers on Monday and ask them to confirm that I am covered and was covered on a continual basis from policy expiry. If they say that there were insufficient funds when they tried to complete the debit, give them an account from which the debit can be made, but offer a card number there and then. It is likely that the policy will be considered as a follow-on and the documents will show this. You could try blaming a banking error.

With an innocent voice ask if it will be a renewal or a new policy.
If it is a new one, you are screwed.
If it is a renewal, breathe deeply, don't give the game away and take your cert to the police, pick your car up and you won't get done for no insurance.
