Get over to www.pepipoo.com - if you genuinely cannot establish who was driving, then you should be ok, but SEEK ADVICE before you do anything. DO NOT admit to something you didn't do!!!! The Pepipoo fightback forum is a good place to start.

The crown puts the onus on you to identify the driver but you only have to make reasonable efforts to the best of your ability.

I reckon your scenario could work but not if you start quoting ECHR stuff. The mags will think you're pulling a fast one. Be humble instead and give it a go. You should get an alibi to confirm the party or you will be scuppered!
