So basically we’re in the process of setting up the new side of our business and rebranding.

Going to Be looking to trademark the business name, but the question I have is should I just go ahead and apply for the trademark for the business name or would I be better to wait until the branding is done? Or does it make no difference ?

It’s six and half a dozen to me I just want to protect the name more than anything, any advice much appreciated

Don’t know your prior knowledge, but thought this might be useful:

Was it a plaintext mark? No superfluous words?

Right number of classes, and right type? Not too narrow for your needs? Included a broad class as well as specific ones?

Important - Checked your ‘clearance’ yet? ie are there already identical/similar marks on the register? In industry use?

www.ipo.gov.uk

See what categories you want, check availability, pay £170.00 plus £50 for every extra category.

If you're a big company, you'll need a big bill, use a lawyer for a load of extra boilerplate cut & paste

Have you done a trademark clearance search to make sure the mark or your new branding is free for you to use.

I once met a guy who had invested £10k in his new automotive service business, all the branding was done and branded materials had been made. Within a month of trading he got a nice letter from a big player in that the same field because his business name was the included the name of most famous product..
