Council Parking Fine

Left my car parked on double yellows overnight whilst visiting a family member in Birmingham. No off road parking and road parking very scarce. I’m not questioning the offence, it was my wrong.

Anyway, CEO issues a ticket on the 14th October. I only found out yesterday with a letter sent to my home saying the full amount of £70 is due as the 14 day £35 discounted period expired.

I’ve seen the evidence and the CEO fixed the ticket to my windscreen. Fair enough. But someone must have taken it off before I got to my car later that morning. Otherwise I would have paid the £35 no problem.

I emailed the council explaining this but they are still demanding the full amount. Should I bother appealing or no?

EDIT: I was parked outside a convenience shop. Doubt they will have CCTV footage going back to last month but worth a shot I guess.

Ended up just paying the £70. More hassle than it’s worth to try and contest it especially if I don’t have evidence of the ticket not being on my windscreen when I went to my car that morning.

As a matter of interest how would you plan to get evidence the ticket wasn't there?

The car was parked outside a local convenience store. I could go back and ask if they still have CCTV footage of that morning but no point now.

Councils are s as far as I'm concerned when it comes to the motorist. I once parked on a dashed single yellow line that also went across the entrance to a side road that was a dead end. I appealed and still lost. Unbelievable, snotty lawyer quoted de minimus or something. Very biased towards Nottingham city council. Lord know how much money they raked in on that piece of road.

But in this case the OP admitted he had parked on double yellow lines. Are you saying there should be no consequences for parking violations?

Yes I have viewed the evidence. The CEO took a photo of the ticket on the windshield.

The offence took place last month and I only just found out yesterday upon receiving a letter in the post saying the 14 day period to pay the discounted half sum had elapsed and that I had to therefore pay the full fine.

The reason I didn’t know about the fine is because someone had obviously removed the ticket from my windshield that morning or the wind or whatever blew it off. Otherwise like I said, I have no issue with admitting to the offence and would gladly have paid the discounted sum.
