Ebay buyer claiming for 'consequential damage'
Discussion
Hi Chaps,
About three months ago I sold on Ebay a set of injectors I'd had stting in the garage for many years (for a Citroen BX GTi). I'd bought them as useful 'things that might come in handy' (when I was into that sort of thing!) - in an untested 'as is' condition - but never had occasion to try them.
My Ebay advert clearly stated that the injectors were untested - and priced accordingly. The buyer is now complaining that some piston hole damage has been caused by one of these injectors - fitted by a 'reputable garage' as part of an engine overhaul. He is now claiming that I should re-imburse the cost of the garage work
I haven't replied as yet - just wanted to gather opinions on how to play it. Details of the original listing seem to be no longer available on Ebay because of the elapsed time.

Has he opened a case against you on ebay? They don't "delete" anything, they'll have just have hidden it.
He hasn't got a leg to stand on if they were as described, problem is ebay always side with the buyer. He definitely doesn't have a chance on 3rd party losses - whats to say they didn't drop one of them?
See so many of these types of threads now, I had the same kind of issue with a car that I sold - makes you want to not bother selling owt, not worth the hassle.

He's also asking to be re-imbursed for the original purchase (£17 for four injectors). If I do this (purely as a goodwill gesture), am I potentially admitting some further liability?
You have no obligation to do that at all and I would suggest that doing so would be a silly thing to do.I wouldn't reimburse the original purchase price incase it goes to small claims and it counts against you, ask him for some proof that the injectors are faulty (flow test results).
Edit: I've had injectors cleaned which have then dried out and needed a sharp tap to get them to work again so imo with old injectors of unknown origin which had been sitting a while the garage should have tested them and make sure they actually worked before fitting them.

Wow - don't know any garages "reputable" enough to fit untested used parts during an overhaul...
Maybe the OP could hook me up pls?
Perhaps they exist, but only deal with tools that would rag a crusty old AX with what must have been a serious misfire for long enough that the eBay buyer guarantee expires, as does 1x piston?

Tell him to jog on! I can't believe the gall of some people!!
I've recently bought some used injectors off eBay for my motorbike, to try to see if they solve a fueling issue. I I pop them on and my engine goes bang then that's my tough tits. Caveat emptor and all that!
Any garage fitting used parts (good luck finding one that will do that where I live) should have warned him of problems. Really not your issue.

I think it's just gone past the time limit for opening a case on Ebay.
PayPal allow complaints for a lot longer though so may not be out of the woods.I would be wary of just telling them to fro as that won't help a PayPal or eBay person looking into this to understand why you're in the right. Would politely explain that they were described as untested and priced accordingly.
