Flaking wheels on X3

Just wondered if anyone has any advice? 6 months ago I discovered the both wheels on the drivers side of my 67 plate X3 were flaking. Now I bought the car new from a main BMW dealer 140 miles away, so when it was due it's first service I took it to my local dealer and asked them to check the wheels. They came back with some disturbing news, they say that the wheels have been refurbished and I should contact the dealer I bought it from as they could not put them forward for warranty replacement. So I did this and the dealer who sold me the car said that they had no record of any pre delivery repairs but I could bring it into them and they would have a look. Being 140 miles away I asked if they could speak to my local dealer as they had already inspected the wheels. 2 weeks went by and nothing, I emailed them with no reply, I called and no one returned my call. I rang my local dealer and they informed me no one had contacted them. Finally I got through to the new car sales manager at the dealer who sold me the car, again he promised to call the local dealer and get back to me, again nothing. I have been in touch with BMW customer services who have got nowhere with the sales dealer, this week it's been back to my local dealer for 4 new tyres and at the request of Customer services another check of the wheels. They have checked the thickness of the paint and it varies around the two flaking wheels by quite a lot. Again they say this really only points to a refurbishment. Customer services have checked for any log of damage between the factory and dealership but there isn't any. They were just about to tell me that they couldn't do much more when I remembered I had a set of photo's I was sent from the dealer that sold me the car in their PDI centre, strangely there is every angle of the car accept the drivers side. Customer services are going to go back to this dealer but I don't hold out much hope. What would be my next step?
