Hi all,im been in my present council house for 11 years,neighbour from hell moves in below.He was thrown out of previous home basically because everyont hated him and he continually cause noise issues and intentionally annoyed his neighbours.He has previously been in jail for stabbing someone,he has hit my neighbours daughter a few years back over the head with an iron bar etc etc.So one day i complained to the police and the council as he would intentionally move his Jeep when i went out on my motorbike so i couldn't get the bike back in when i came home,he left a ridiculous little gap so what happened was,me,obviously yet again pissed off at this,trying to squeeze a 170hp bike through a small gap on gravel by back wheel spun slightly,looked in rear view mirror this idiot is strutting about checking his 18 year old Jeep for stone chips,with a hammer in his hand?When i told the council this the housing officer said,"Oh,maybe he was doing some DIY?"Honestly,you can't make this stuff up,no hammering from th ehouse beforehan,i knew he wasn't in the middle of putting up shelves.They just didn't take me seriously even when i explined his history.Yesterday him and his son were doing the usual thing,staring at me everywhere i go trying to intimidate me,so i do the neighbourly thing and wave to the father(the idiot)I go away to do a couple of messages,come back,he runs up to the car with a 5 feet long twoby two baton and starts laying in about me and the car!I have a fractured patella,badly swollen elbow and damaged ligaments on my knee also.Here's the question,anyone think i've got grounds to sue the council for not getting me out of this situation when i voiced my concerns to them.The police man told me he had thishistory of things and agreed with what i said,if i get police envolvement things will escalate,he also has two nutters across the road who side with him over everything.Anyone any advice?

TBH this really isnt an issue for the authorities or the law in any way or form.

Where to start!

Firstly, make sure you have all this documented - all incidents, times, dates, what was said, copies and dates and transcripts of all communications with police and council.

IANAL but if you can prove that you have made complaints to the council and based on his history I can't see any reason why they couldn't be held to be negligent.

Now :
1. What are the police doing about this? Charged him with ABH/GBH?
2. What are the council going to do about this? Can you get a petition to get him moved with the neighbours.

But I agree with BG, this guy needs bundling into a van, driving onto the moors and to be stripped naked and set about by 5 or 6 heavy blokes with baseball bats. Then leave him to walk home. Then somebody shoot him in the head. (this is not a death threat, etc. etc.)

Unfortunately, plod won't give a rolling donut for you, I'd suggest getting in touch with some one a bit heavy to scare the shit out of him. I know it sounds a bit dramatic but short of earning a few bob compensation and a crime number that's all you're gonna get till he kills someone

I'd imagine he'd be locked up right now?

I'd petition the council to have him moved. If thats unsuccesful, then move yourself.

Antagonising these people is generally a bad idea, they've got nothign to lose.

Have 7 bells of sh!t knocked out of him. Make sure the job is done well. No plod is going to believe his story or care as the geezer has SUCH a history. Ps remember to switch off mobile phone when sortin the minger

The thing that shocked me after it was i saw the neighbour across the driveway who stays alone with his son milling around while this was going on,he said he heard the argument then saw this prat with the wooden baton puting it down,my instinct was he just didn't want involved.My only witness.After he hit me a couple of times and it stopped i just stood there,wasn't shaken up or anything and just basically said what a prick he was,i called him an inadequate little prick and said to him what's wrong with your fists?Why do you have to be tooled up all the time,even against girls,he said "That's just the way i work!?"After that i called him a few other choice names and said i was phoning the police,he said phone them,prove it,prove it!He had a point,well except for my obvious injuries,he's obviously been in this situation a few times and knows how to work the law.Its always the same in this situation,if i had grabbed the stick and retaliated you can all guess what would happen,yeah me in the nick.I showed restraint,kept my cool,he didn't even let me out of the car,he stopped hitting me once i got out.After waiting 50 minutes after calling 999 i gave up,i called them back whilst thinking,im wasting my time here anyway,just cancel the police prescence.This is the hard part to believe,someone suggested in this post clubbing together with neighbours,the two guys across the road(both done time)went to the girl's next door and partied together with this idiot!This prick downstairs sauntered by my house whistling with a bottle of beer,for my benefit probably incase i was looking.If i do something now it's going to be obvious its retaliation by me.

Seriously, in your position I would really try to get him punished outside of the law, if this is not an option or you are more sensible then just move as this cock obviously isn't really worth making your life any more miserable for. Of course once you have moved...

For an assault like that, I doubt you'd need witnesses. The physical injuries, his history, and the fact that hes probably so thick he keeps the bit of wood in his house should be enough for the police to go on.

I personally went to the police station to log the assault.I didn't press charges eventually as when i sat and said if i get the police to his door it will just aggravate him further,the policeman agreed and said yes,he's done that before,he just gets worse and worse.After waiting 50 minutes on the police coming to my 999 call as i said, i just gave up,just called them back and told them not to bother.

If it's any conselation mate, my neighbors drove me to loose it.

In frustration I kicked a cement a cement mixer and broke my foot.

Boy did they laugh. The laughter I can cope with, the pain is a pain.

Feel really sorry for you and your injuries. Sods law - whatever you do is going to give you further serious grief + moving in your state is hardly possible.
You have 4 choices:-
Ignore him and hope he cools for awhile or finds someone else to pick on and taunt
Prosecute him and be damned of those consequences. He would have to be bailed and you can get bail restrictions placed on him and police protection etc.
Go to council and insist you are re-housed!
Or, give him a real taste of his 'own medicine'
Very difficult choice especially when so unwell but in the meantime CAB will offer help while you make your decision.
BUT don't ever let him do that to you again. You can defend whatever the final outcome to him

If you want to go the legal route then try your local MP. They are normaly quite helpful and more than willing to try and get things moving even if it only to get you rehoused. If this doesn't work then I would invest a grand or two to have whatever needs to be done.
