Before I get flamed, I’m just looking at options...

I have a current lease expires mid June.
I have ordered a new lease direct from a dealer with requirements stated as needed for mid June.

Current position is that due to the Covid situation, dealer doesn’t know when car will be delivered and can’t find out from manufacturer due to European factory closures.
All as you would expect.

Currently we have another car, so don’t need 2 vehicles.

If I wanted to, could I cancel the order with the dealer?
All I have signed is an order form that states:

I confirm the information stated above has been agreed, and is correct at this stage.
I confirm that my signature is confirmation to proceed, and to place a vehicle on order for stated.

The order form just has my details, car details etc.
No delivery date or other commitments or associated T’s and C’s.

It’s not really relevant but considering either saving the cash for a while, or if needed and things get back to normal ish late summer buying a second hand cheapie whilst I sort a new lease out.

One practical problem you'll have is who to yet it to. Is there anyone to receive a letter or email?

Anyway, why don't you just do it? Send a letter cancelling. Then when work starts again and they respond you'll know if you have a fight on your hands or not.

I expect it'll be accepted, but it's only a guess.

The dealer seems to be responding to enquiries at this point. I’m just interested in the legal position of being able to cancel as one of my options.

Go on the BMW forum and ask on the 8 series thread , as there is a few of them looking at cancelling the leases.

Also as a follow up, if my present lease expires and the lease co. can’t collect it am I legally obligated to:
a) pay my monthly lease payments?
b) insure it?

As info for anyone else with Lex, this is also their official position:


I would still like to end my contract agreement:
Please email Customer Services on customer.services@lexautolease.co.uk and mark in the subject field ‘Vehicle Return Request’. Please confirm your intention to return the vehicle and provide the current mileage. Although we will be unable to arrange for the vehicle to be collected until further notice, we will agree a contract end date. We will not be charging you monthly rental payments following notification that you want to return the vehicle.
Please note if you are wanting to end your agreement early you may be subject to an early termination charge. Please email Customer Services on customer.services@lexautolease.co.uk who will be able to provide details.
Stop using the vehicle from the end of contract date and we will arrange alternative insurance to cover the vehicle after the agreed end date until we can arrange collection. You will not be insured to drive the vehicle after this date.
Please keep the vehicle in a safe and secure location to minimise the risk of third party damage and do not use the vehicle. The vehicle must not be driven from this point as the driver will not be insured.
Please note, you will still be liable for any excess mileage charges if you have exceeded your contracted mileage limit.
