Private Road Parking Issues!!!

Hi,

I live on a private residential road with 5 other residential houses. We all own the private road jointly.

However, 1 of the neighbours parks 3 of his cars on the side of the private road as they do not have enough space on the driveway. This makes it slightly difficult for deliveries with big vans or lorries to deliver items to my property.

It doesn't effect the other neighbours as much as they live at the start of the private road whereas I live at the end. They live next door, hence the 3 cars parked on the side are mostly effecting me.

Is there anything I can do about this as we have had a conversation about this in the past which did not go down well and we do not speak anymore due to this.

Is there a written agreement about the terms of ownership of the road?

On the deeds, we are all jointly responsible for the upkeeping of the private road. There's nothing specific in terms of how to use it.

Is that is all that is referred to?

Have you spoken to all the neighbours to see if they've an opinion?

Mind, if somebody doesn't have enough space to park their cars I suppose they've not got a lot of options.

I've not spoken to the other neighbours but it doesn't effect them as much/if at all as the cars are not blocking their way.

They have a total of 4 cars in which they only use 2.

1 is even SORN so doesn't move.

Is there anything I can do about this as it's a private road or does this have to go through lawyers?

IANAL but as I see it this is why shared roads are so feared in a property purchase.

It's private land, so not a police matter.

There's nothing in your deeds concerning use or parking either, so nothing to challenge there.

You say you mentioned it to your neighbour, but it went south and now you don't speak - what happened? Did you argue? Was he dismissive?

Your best option may be to get him on side and see reason.

I was very specific on my private road by way of covenant that the 3 properties using it aren’t allowed to use it for parking.

Unfortunately my neighbour is my dad and although I’m forever dropping hints and I’ve offering a spare space he still parks on it

Yes, he was dismissive of the idea of moving his cars as I asked him due to a large delivery for my property.

A Fire Engine would be able to get past but only if they mounted the curbside.

Talking to them about this again would not be an option as they were so adament that they were not going to move their cars.

I'm not sure what other options I have?

How much bigger than a fire engine are your large delivery vehicles?

The point i'm trying to make is that surely it's very inconsiderate to park all 3 cars on the side when I am renovating my house so building merchants are delivering goods to my property.

It's also a nuisance trying to reverse out of my driveway as its quite narrow with the cars parked on the side.

They do not use 2 of the cars and as mentioned 1 is even SORN.

I don't know if there's any resolution to this? Could I take this to a lawyer?

Could be and probably am wrong here but a private road with no gates to prevent reasonable public access means the car would still need to be taxed and insured.

Aside from that’s route I reckon you’re stuck with asshole neighbours.

How? do you just own the bit in front of your house? or is the whole road owned by all residents separately? what does the land registry say? If you only own the bit in front of your house, there must be a right of access on the registration of the other properties surely? have you downloaded the registrations of your neighbours to check? 4 suggestions. Check with land registry. post on gardenlaw rights of way forum where there are some experts. Check house insurance for legal expenses cover. Check original planning conditions if these are newish properties.

How long is this road, and what is the layout? Is he parking opposite your drive, or is he parking down the road? Is is a straight road with houses in a line, u-shaped, parallel?

Maybe a discussion with the rest of the residents can have something added to the deeds around acceptable parking? Would probably only need a majority to be carried out, but be careful as he may then want to add something that you won't like.

Not sure what the SORN status of one of the vehicles has to do with anything though, and I'm sure he can't physically drive all 4 at the same time anyway.

We all own the road equally, we do not own any parts of the road separately from one another.

The private road is small and they park directly infront of my driveway on the side of the road where there are bushes/fences.

Take a step back. Are you making something out of not very much? Have any delivery drivers told you they had any difficulty? Are you actually able to get off your drive without much fuss?

Is this more an issue that they’re parking opposite your driveway, rather than their own, as they live next door, but are parking opposite your driveway?

I can’t believe that a private road doesn’t have much by way of a legal document that details every little thing expected and required of each home in the street. You’re not really giving people much to go on and are dripfeeding info, which is a bit frustrating. Can you post up the deeds for the road, I’m sure someone with a level of expertise in that area could offer up a suggestion or two, although it’ll just be a suggestion.

In answer to your question of taking it to a solicitor, of course you can. You can take anything you like to a solicitor, whether you’ll get the answer you want is open to discussion, even then a court may disagree with you and your solicitor if it gets that far.

Bad neighbours are bad neighbours, and falling out with them tends to be a lose lose situation. You may just have to live with the hassle. Even dobbing in the SORNed car will probably just inflame things. Litigation would make things much worse, and absent some legal restriction on use of the road, and it appears that there is none, would not produce a good outcome.
