Resigning while on Furlough ?
Discussion
Seems I have a job offer coming to me in the next few days. Nothing currently set in stone as a start date. But being furloughed with my current employer, how can I do this ? Been searching and not found much on it and differing opinions on legal sites etc. Do I hand my notice say 1st June, furlough for the month ? Be kicked out from 1st June ? Hand notice 30th June, get kicked out 30th June ? New job 1st July ?
From the info my current employer sent to furlough me, he had nothing in there stating requirements, should any employee decide to leave. So, leaving potential options open, i guess, as not expecting people to leave.
I am working at a competitor, which normally means garden leave immediately , but being sat at home currently , I suspect I will venture to the office to clear my desk, hand back laptop and phone pretty early on .
Anyone have a similar situation or any advice on this please ?

It happened to my daughter.
It was straightforward. She had applied for the role before being furloughed, received the offer during furlough,, handed her notice in (1 month period) and started with her new employer a couple of weeks ago. They dropped off a laptop via Courier and she's been WFH.

Your notice period will be the same as your original contract, they would need to keep paying you the same as currently for your notice period.
However if you are already on furlough, I suspect they will be happy to reduce this to nothing, you'll need to ask.
(This is my common sense response, but often employment law is more complex than common sense)

I’ve just done the same. Got offered another job whilst on furlough and gave existing company my months notice to leave the end of may. Informed new company I’d start 1st June. No issues and nothing asked of leaving early etc.
Your still employed even when furloughed. I think it’s a situation where you could use it to suit yourself as I’m sure the company your leaving wouldn’t mind you finishing early etc.

Thanks for the help all. I 'guess' I will just resign with a months notice , be paid on furlough for that period ? , then start with the new company. Sounds simple enough , if thats the case.
I am guessing that it will still be 'garden leave furlough' and for tax reasons, will have to sit at home, with no laptop or work phone for a month............what a disaster

if it is normal for people to be gived garden leave, you could ask for pay in lieu of notice (PILON), although this isusually just base pay and doesnt include and bonuses or benefits, this effectively enables you to be paid twice to work the same month, 1 month pay from old job then immediately start at new job and get paid aswell
I'm in a similar position myself, and was directed to this thread.
I've been made an offer I'd be mad to turn down, but as I'm on furlough I want to ensure I don't get done over (as my current employer are a stingy lot at the best of times) and paid what I should be during a 4 week notice period. I'll have unused holiday, but reading online there is disagreement as to whether notice should be at the 80% furlough rate or the 100% normal rate.

I’ll only be getting my 80% for my notice period. But I planned my notice to suit me. Our wages go from middle of the month to middle of following month, and the new job goes from the first of the month etc, so by me leaving at the end of this month and starting new job on the first; at the end of June I’ll have a full month pay from new job, and 2 weeks pay plus unused holidays from existing job. I had holidays booked the beginning of April but cancelled them as I was on furlough and so now will be paid for them being unused. The way I worked out giving my notice and starting my new job means I’ll be getting 7 weeks pay at end of June. 2 weeks plus a weeks holiday from old job and a full month from new job.

That was my thoughts on who pays etc. I also have had only 2 days leave this year ( Jan to Dec it runs ) and as such an email from my MD said no leave during furlough and will be carried over . If I leave by end of June, then I have about 10 days owing. Will they expect me to finish furlough early and then get paid my salary to clear the outstanding leave or furlough to the end of June and pay me the leave ? Just another thought to this.I've been made an offer I'd be mad to turn down, but as I'm on furlough I want to ensure I don't get done over (as my current employer are a stingy lot at the best of times) and paid what I should be during a 4 week notice period. Holy thread resurrection !! Just a long awaited ( more than likely completely forgotten about thread) but I have hung onto the original job and the new job has been waiting for the right time. After further discussions, I am resigning on Friday this week and taking up the new job offer. Not sure if this has been the longest job wait but both myself and the new employers were unsure on business situations and furlough but hopefully this new move gives me more to aim for for the future.
